Town Board Meeting

April 14, 2010

Present:

      1.       Meeting Called to Order for the Town Board Meeting

Supervisor James Armstrong called the meeting to order at 7:00 PM.

•  Minutes Approvals

                  A .   March 10, 2010 and April 5, 2010

Councilman Dailey made a motion, seconded by Councilman Winters to approve the meeting minutes of March 10, and April 5, 2010   Ayes - 4       Nays - 0

•  Approval of Town Clerks Report

Councilman Winters made a motion, seconded by Councilman Dailey to approve the Town Clerk's Report for March, 2010.   Ayes - 4        Nays - 0

•  Approval of Justice Report

Councilman Winters made a motion, seconded by Councilman Putney to approve the Justice Report for March, 2010.   Ayes - 4          Nays - 0

•  Recognition of Guest

Russell Finley presented a bill of $1,650.00 to the Town of Lisbon for damages that were done to his fences and yard during the winter months of snow plowing. He commented that this has been going on for the last three years. Mr. Finley stated that he expect to receive payment for the one year. If not he stated that he would sue the town for the three years of damage that has occurred.

The bill consists of: 425 feet of rail fence - $1,000.00, Dump Truck Load of Top Soil - $350.00 and 6 hours of skid steer and operator $300.00.

•  Approval of Abstracts

Councilman Dailey made a motion, seconded by Councilman Winters to approve the abstracts for March 2010. Supervisor Armstrong stated that he received a bill from Burley - Gemmiak and Associates for $6,971.00 .   He is questioning why the high expense.   He would like to speak with Andy Dodd to ask for a reduction.

      8.       Approval of Supervisor Report

Councilman Dailey made a motion, seconded by Councilman Winters to approve the Supervisor Report for March 2010.   Ayes - 4        Nays - 0

      9.       Highway Superintendents Report

The 2010 Road Plan is completed.   Superintendent Dow requested that the board approve the road plan, as is, in order to submit it to the county as soon as possible.   If at a later date the board would like to amend the road plan it could be done then. Town Clerk McBath asked why dead end roads were going to be paved.   Highway Superintendent Dow stated that on the North Road there was hardly any more room to build houses and there was a lot of traffic. He stated that with the road being four tenths of a mile, there were approximately 50 cars that travel back and forth. Councilman Dailey stated that he had a problem with newly paved dead end roads. He would like to place the dead end roads at the bottom of list to be paved at any time. Highway Superintendent Dow stated that if the road plan was submitted early, then the Town of Lisbon would be on the list with the County to get its roads paved early.

Councilman Winters made a motion, seconded by Councilman Putney to approve the road plan as is for 2010.   Ayes - 4       Nays - 0

      10. Report from Legislators

Legislator Forsythe informed the board that he didn't have much to report.   The Legislator was still working on the county budget.   They are going through each department to see where they can cut expenses.

11. Report from all Liaisons for Committees

A.       Planning Board - Councilman Shoen   - No report as he is out ill

•  Campground - Councilman Winters stated that the bath house is being worked on.   It was asked when it would be completed.   It was asked when the campground was due to be opened.   Town Clerk McBath stated that it is schedule to be opened on May 15, 2010.   Then it was asked if the bathhouse would be completed by then. Highway Superintendent Dow replied that it would be.

C.       Library Board - Councilman Winters reported a new gate would be installed on the stairs. Scott would be installing it.

D.       Homecoming - No report

E.   Museum Committee - Councilman Putney had nothing to report, as he was not able to attend the meeting.

F.        Recreation - Councilman Putney stated that he had a list of the supplies from Howland Pump for the water and sewer in the recreation building. He requested that Doug Smith be able to place the order.

Supervisor Armstrong asked if he knew if there was insurance and how much was on the Recreation Building at the park. Councilman Putney did not know if there was or wasn't insurance on the building.   Supervisor Armstrong asked Town Clerk McBath if she would check to see if there was insurance on the building. Councilman Putney asked who would pay for the insurance - the recreation or the town.   He was informed that the town would pay for it since it was a town building.

Town Clerk McBath asked who was doing the plumbing for the recreation building.   Councilman Putney stated he thought Doug Smith was helping when possible, and asked Highway Superintendent Dow if he was going to work on it. Attorney Nash stated that Roger Watters left something at his office concerning the easement from United Helpers.   Councilman Dailey asked what was happening with the grant.   He was informed that it was still in the paper work.

The recreation committee would like to get a key for the Library so they can open and close the Library when they use it.   Supervisor Armstrong stated that in the past whenever anyone wanted to use the Library, they would pick up a key from the Town Clerk that day and return the key when finished. Councilman Winters stated that would not work as the Library Board would not hand out the key. In the past, things had come up missing, and kids roam around upstairs. Supervisor Armstrong stated that since a new gate was being installed, there should be no problem with people using the downstairs.   It was a community room, and people should be allowed to use it. These are responsible people, and the Library would be promoting the use of the building.

Councilman Putney stated that they would need a load of clay and sand for the pitcher mounds at the park. He also requested that posts and rope be put up along the driveway so people could not park on the ICF lawn. He felt it was a temporary set up. Highway Superintend Dow stated that he had the posts and rope.

G.       Animal Control - Animal Control Report From 02/07/2010 to02/28/2010 is attached           

      13. Old Business

                  A.   New Horizons Wireless - Chad Rice

The contract was signed by a councilman, but was not approved by the board, so the contract was now void. Supervisor Armstrong asked for Attorney Nash to look over the contract that was revised.

                  B.       Guard Rails for opening at bridge

A discussion was held in Executive Session. When the regular meeting reconvened: as follows:

Councilman Winters made a motion, seconded by Councilman Dailey to have Attorney Nash draft a letter to the Vermont Rail Road concerning responsibilities and maintenance of the barricades on town property for the bridge that was removed.

Ayes - 4       Nays - 0

Attorney Nash asked if the board wanted to put in the letter that time was of the essence. If need to, the board agreed to a special meeting.

                  C.       Shooting range

Supervisor Armstrong stated that Attorney Nash had looked over the contract and approved the contract.   The Ogdensburg Correction Facility has full responsibility of who and when individuals can be at the range.   Supervisor Armstrong asked for permission to sign the contract from the councilman.

Councilman Dailey made a motion, seconded by Councilman Winters to approve Supervisor Armstrong sign the contract with Ogdensburg Correction Facility for the Shooting Range

      14.   New Business

                  A.                   Health Insurance for spouse after employee retires

Supervisor Armstrong stated that the employee's spouse was eligible to purchase the health insurance as long as they agreed to pay for the full premium.

•  Dog Licensing fees & fines

Town Clerk McBath informed the board that she had been sending out Notices of Reminders to license dog owners.   If the dog(s) were not licensed in a timely matter they would be receiving a ticket for unlicensed dog(s).   If and when they go to court, the count would not fine them for unlicensed dog(s).   She wanted to know if anything could be done.   Attorney Nash stated that nothing could be done.   Only the court can dictate what they want to do with the tickets.

•  Beach and Campground Fees

Since the campground had already accepted reservation for the campground, and some have prepaid, the board felt that it would not be right to increase the fee at this time.   Fees are as stated.

Seasonal Site Rates - To receive Season Site Rates the person has to camp at the campground for 30 days or more. They will receive a 10% discount if paid in full at the time of entering the campground.

Senior Citizen needs to get a Senior Citizen sticker to be able to get into the beach without charge for a scenic view of the beach area.   They would need to be 65 years young to receive this sticker. Supervisor Armstrong asked if Town Clerk McBath could order such a sticker.   Town Clerk McBath asked if she could reorder the stickers for residence and non-residence for the year.   She was informed that she could order them.

•  Town Logo

Scott Wilhelm asked for a copy of the Town Logo for the Recreation web page.   Town Board and Town Clerk McBath said no as it is a private logo for the town.

•  Carpet Clean in Town Hall

Town Clerk McBath asked if she could get the carpet cleaned through the Town Hall, as it has not been cleaned since the carpet was installed in 2004.   The board asked for her to get an estimate on the cost. It will be discussed at the next meeting.

•  Land on Pray Road

Town Clerk McBath informed the board that the Lisbon Fire District was still interested in purchasing the land on the Pray Road. Councilman Dailey stated that he was interested in selling it to them. Councilman Putney asked if the town had heard anything from the residences on Church Street. Councilman Dailey stated they had not been notified yet. Supervisor Armstrong stated that the board should first decide on whether or not it should be sold. Second thing would be to inquire if Robin Moore would like to purchase the land back.

Supervisor Armstrong asked the board members if they wanted to sell the land.   Councilman Winters stated that he did not want to sell it. Councilman Dailey wanted to sell the land, since he saw no value in it for the town.

Wade Davis CEO from Bridge and Port Authority, asked to speak concerning the Railroad Crossing. Bridge and Port owns the railroad, NY in Ogdensburg operators the railroad.   Corrections in last months minutes stated that Ogdensburg Bridge and Port Authority and NY in Ogdensburg oppose the installation of an access road. There is, however, an administration law process to install a crossing. It is the same process of the removal of the bridge. Supervisor Armstrong stated that it would be an asset to have a crossing for emergency vehicles in times of emergency.

Councilman Putney asked what value the land was for the town.   Councilman Winters stated that the town owns the land and they don't own very much land in the Hamlet of Lisbon.   Councilman Dailey asked why the land was necessary, if the water and sewer district could not be expanded. Councilman Winters replied that in the future if the town wanted to build a new Municipal Building to include the Town Barns, that would be the place to construct it.   Councilman Dailey stated that he felt the land was not purchased properly.   He felt the land was purchased and then the taxpayers were informed. That was not good government. Attorney Nash stated that the land was purchased properly, just that Councilman Dailey disagreed on the way it was purchased.

Mr. Davis suggested that the town could go through the administration process to see if the town could get an emergency cross for emergency vehicles only.

Supervisor Armstrong asked for comments from Highway Superintendent Dow. Highway Superintendent Dow replied if the town wanted to construct a new municipal building, the land would be the place to build it, as the town does not possess other land in the village for it. Supervisor Armstrong stated that even if the town decided to keep the land, he still would not object to the people purchasing a buffer in back of their homes. Councilman Dailey requested for this to be tabled until next meeting.

•  Lisbon Adult Basketball Recreation/Jack Gray

The Lisbon Adult Basketball Recreation fund has been with the school for many years.   Since the school does not have their accounts with the Upstate National Bank, they would like to remove it from the school. Jack Gray is requesting that the account be placed in a town's account and call it Lisbon Adult Basketball Recreation/Jack Gray. Town of Lisbon will not add any money to the account, or remove any money. Money that is collected by the players will be added to this account. Then the account will be used for paying the janitor to be at the school when needed.

Councilman Dailey made a motion, seconded by Councilman Putney to allow the Lisbon Adult Basketball Recreation/Jack Gray to open an account under the town.

•  Executive Session

Councilman Dailey made a motion, seconded by Councilman Putney to go into executive session at 8:00 PM for purpose of potential contract.   Supervisor Armstrong asked for Wade Davis, CEO of Ogdensburg Bridge and Port Authority to be present.

Councilman Dailey made a motion, seconded by Councilman Putney to return to the regular meeting at 8:20 PM             Ayes - 4           Nays - 0

A motion was made and place under Old Business Item B.

           16.         Adjournment

Councilman Dailey made a motion, seconded by Councilman Winters to adjourn the meeting at 8:30 P.M.   Ayes - 4             Nays - 0

          17.           Reopening Meeting

Councilman Dailey made a motion, second by Councilman Winters to reopen the meeting on the discussion of the bill that was presented to Supervisor Armstrong from Russ Finley.

Ayes - 4             Nays - 0

Supervisor Armstrong asked for the advice from Attorney Nash concerning this bill that Russ Finley had presented.   Attorney Nash stated that the board needed to take a vote on whether they want to pay the bill or not.   He stated that it did not appear that it was an acceptable form of noticeable claim under general municipal law section 50. The person has ninety days to put a claim in. This claim did not state when it happened.   It did not state if it was a continued event or a single event.   Attorney Nash commented on the threat that Mr. Finley stated of suing the town for the last 3 years was probably an idle threat because there was no claim for the last three years.

Councilman Putney asked Highway Superintendent Dow if he was going to check on the right a way for the road.   Highway Superintendent Dow as for it to be noted that this was the first time of hearing from him other than from Councilman Dailey when he informed him of these incidents.

Councilman Putney made a motion, seconded by Supervisor Armstrong to not pay the bill.
