TOWN OF LISBON Town Board Meeting March 10, 2010 Lisbon Town HallPresent: Supervisor James Armstrong, Town Clerk Donna McBath, Attorney Charles Nash, Esq., Highway Superintendent Timothy Dow, Councilman Alan Dailey, Councilman Nate Putney, Councilman Vincent Winters, Councilman C. Meeting Called to Order for the Town Board Meeting Supervisor James Armstrong called the meeting to order at 7:00 PM. 2. Pledge Allegiance 3. Minutes Approvals A. February 10, 2010 Councilman Winters made a motion, seconded by Councilman Dailey to approve the meeting minutes of February, 2010. Ayes - 5 Nays - 0 4. Approval of Town Clerks Report Councilman Winters made a motion, seconded by Councilman Shoen to approve the Town Clerk's Report for February10, 2010. Ayes - 5 Nays - 0 5. Approval of Justice Report Councilman Dailey made a motion, seconded by Councilman Shoen to approve the Justice Report for February, 2010. Ayes - 5 Nays - 0 6. Recognition of Guest Donald Hassig gave a presentation on Public Education Initiative of Cancer Action. See Resolution #3 of 2010. Jeff Pellerin asked how he could be appointed to the Recreation committee. Supervisor Armstrong told him to inform the Recreation Chairman and when the Recreation Committee approves him, have the Recreation Committee bring his name back to the Town Board for approval. Jeff also wants to fix the Little League Baseball Field at the ICF and the Baseball field at the Lisbon Beach. He presented a plan to the Town Board. He has contacted the Ogdensburg Correctional Facility and the Riverview Correctional Facility to use Inmates to help with the work. He needs letters from the Town Board sent to the two Correctional Facilities for approval of inmates to work. Jeff is going to see if he can get sod, clay and topsoil donated if possible. Supervisor Armstrong gave him the go ahead and he can work with Councilman Dailey and Councilman Putney of the Recreation Committee. Patrick Green spoke on the Industrial Development Agency. Will bring resolution to next Board meeting to investigate the IDA. 7. Approval of Transfers Councilman Winters made a motion, seconded by Councilman Shoen to approve the transfers for February 2010. Ayes - 5 Nays - 0 8. Approval of Abstracts Councilman Dailey made a motion, seconded by Councilman Winters to approve the Abstracts for February 2010.
Ayes - 5 Nays - 0 9. Approval of Supervisor Report Councilman Dailey made a motion, seconded by Councilman Winters to approve the Supervisor Report for February 2010. Ayes - 5 Nays - 0 10. Highway Superintendents Report Highway Superintendent reported that he is working on road plans for the year. Waiting on prices for asphalt. Also that most of the new lights have been installed, and that the snow removal budget is down. 11. Report from Legislators Legislator David Forsythe reported on the Co-Generator plant. He is still against raising the county sales tax. 12. Report from all Liaisons for Committees A. Planning Board - Councilman Shoen - Acknowledgement of new Board Member Ronald Sanderson as board member David Smith resigned Planning Board. Councilman Dailey made a motion, seconded by Councilman Winters to approve Ronald Sanderson for the Planning Board to replace David Smith. Ayes - 5 Nays - 0 B. Campground - Councilman Winters reported on the plans to refurbish the old bath house at the Lisbon Beach. Old bath house needs some repairs but not to the scope of the proposal of $118,471.00 from Burley- Guminiak & Associates, Consulting Engineers. Councilman unanimously agreed to reject the recommendation of a study calling for $118,471.00 in renovations to a bathhouse at the town owned beach. The board agreed that the project could be performed at a smaller scale. Councilman Dailey made a motion, seconded by Councilman Shoen to have Councilman Winters and Councilman Putney get three quotes for building materials for the bathhouse and bring to the next meeting. The money to repair bathhouse would not come from tax payers but from the NYPA. Ayes -5 Nays- 0 C . Library Board - Councilman Winters reported that they would like some new outlets for the computers as they have wires everywhere Also, would like someone to clean and shampoo rugs. D. Homecoming - Roger Watters reported that Homecoming is going to be August 20, 21 and 22 this year. The Committee received numerous complaints about considering not to have a fireworks display. After much discussion they agreed to look into cost of fireworks with entertainment on Saturday night at the beach. Lisbon Central School has agreed to allow a concert Friday night in the auditorium. The theme for Homecoming will be to honor local businesses. A roast pork supper was suggested as a fundraiser. May 21, 2010 was picked for the date at 4:30 P.M. It will be held at the American Legion and Bill Fobare will cook the pork. Next meeting will be April 5, 2010 at 6:00 P.M. at the Library. Current volunteers that will be working in various phases are: Linda Hicks, Mike Light, Mary Jean Chester, Debbie Whitehill, Arlene Middlemiss, Dorothy Middlemiss, Ed Knight, Debbie Putney, Chris Hammond, Angie Bigelow, E. Museum Committee - Councilman Putney had nothing to report. F. Recreation - Councilman Putney reported that the water and sewer is ready to be installed at the new town recreation building at the IFC Field. Councilman Dailey made a motion and seconded by Councilman Putney to get the water and sewer connected to the Recreation building done as soon as possible. Ayes -5 Nays - 0 Sheila Mehaffy would like to get a sales tax exempt credit card for purchases for recreation. Have Sheila Mehaffy get a Sales Tax Ex. Form and number from the Town Clerk's Office. Attorney Nash said you should check with the Insurance Company to see if the new building is covered at the ICF Field Councilman Winters made a motion, seconded by Councilman Putney to have the Recreation committee meet with the Superintendent of Schools as to have better cooperation between them both on recreation and use of school property. Ayes -5 Nays 0 G. Animal Control - Animal Control Report From 02/07/2010 to02/28/2010 is attached 13. Old Business A. New Horizons Wireless - Chad Rice Chad Rice from New Horizons Wireless discussed the Equipment Placement Agreement previously submitted to the Town Board, after having Attorney Nash look it over, his comments were that any agreement that goes ten years is too long, given the changes in technology that may occur. Also, that the Town doesn't want to get into the position of swapping tower space for Internet access. Cash works well in all economies. We could then determine what we want for Internet access and we do not have to worry about a service problem. Also he does not like the "Hold Harmless language under the release. But it is up to the Board to decide. Mr. Rice said the contract was not set in stone we could negotiate. Councilman Shoen made a motion and Seconded by Councilman Winters that the board appoint Councilman Dailey and Councilman Putney to negotiate a contract and bring it back to the board for consideration. Ayes - 5 Nays 0 Mr. Chad Rice also would like a Letter of Intent for ("Rural Utilities Services ("Rus") Broadband Initiatives Grant Program. Supervisor Armstrong will have the Town Clerk prepare the letter. 14. New Business A. Resolution # 3 - 2010 - Resolution in Support of a Public Education Initiative of Cancer Action NY RESOLUTION # 3 of 2010 Resolution in Support of A Public Education Initiative of CANCER ACTION NY WHEREAS, The incidence of cancer in Lisbon is of great concern to the Town Council; and WHEREAS, The presence of dioxins in the food supply is a key contributor to the problem; WHEREAS, Many citizens are unaware about steps that can be taken to lower the incidence; and WHEREAS, The problem is not isolated to Lisbon, but requires a regional or national response; now, therefore, be it RESOLVED, That the Town Council for the Town of Lisbon, meeting on January 11, 2010, does hereby commend the organization CANCER ACTION NY for its efforts to raise awareness about the problem; and, be it further RESOLVED, That the Town Council calls upon its elected officials at both the State level and Federal level to use their influence to help warn Americans about the danger of dioxins in the food supply; and, be it further RESOLVED, That the Town Council encourages its citizens to be mindful of the dangers and supports initiatives that will promote the health and happiness of its constituents. March 10, 2010 By: James W. Armstrong, Town of Lisbon Supervisor Councilman Winters made a motion, seconded by Councilman Dailey to accept the Resolution # 3 - 2010 Support of a Public Education Initiative of Cancer Action NY. And Supplement to Resolution #3 of 2010. Ayes - 5 Nays - 0 Added an amendment with Resolution Polybrominated diphenyl ethers (PBDEs) are persistent hydrocarbon pollutants. PBDEs are utilized in the manufacture of fabrics and plastics. It has been conjectured that dust and indoor air may become contaminated with these pollutants. These chemical compounds are soluble in fat. Food sample analysis has demonstrated that these pollutants contaminate animal fat. It appears that animal fat consumption is not the only significant exposure route. Animal studies have shown that exposure to PBDEs imposes increased cancer risk. Education of the general public concerning the animal fat consumption and possible dust/indoor air exposure routes is necessary as a cancer preventative measure. B. Resolution # 4 - 2010 - Resolution in Promote Participation in the 2010 Census with the Town of Lisbon RESOLUTION # 4 of 2010 TO PROMOTE PARTICIPATION IN THE 2010 WITHIN THE TOWN OF LISBON WHEREAS, the U.S. Constitution mandates a headcount every ten years, which is accomplished by the decennial Census process, and WHEREAS, population data from the Census are used to determine the number of seats each state has in the U.S. House of Representatives, as well as boundaries for legislative districts across New York State and within St. Lawrence County, and WHEREAS, Census data are widely used by every level of government in New York State to allocate over $40 billion in program funds, and WHEREAS, The Census Bureau has asked for assistance of local governments organizations and individuals across the country to help build public awareness about why the Census is important, and to encourage every person in their community to participate, WHEREAS, the unemployment rate in St. Lawrence County is one of the highest of New York State's 62 counties, and NOW, THEREFORE, BE IT RESOLVED, that the Town of Lisbon does hereby support the efforts of the Census Bureau and of St. Lawrence County's Court Committee to promote participation by all residents of The Town of Lisbon in the 2010 Census, and BE IT FURTHER BE IT RESOLVED, that the Town of Lisbon does hereby request the local agencies, service organizations and community leaders throughout the Town of Lisbon work together to promote maximum participation in the Census. March 10, 2010 By: James W. Armstrong, Town of Lisbon Supervisor Councilman Winters made a motion, seconded by Councilman Dailey to accept the Resolution # 4 2010 To Promote Participation in the 2010Census within The Town of Lisbon. Ayes - 5 Nays - 0 C. Gasoline Quote Two bids were received for gasoline. MX Fuels for 232.25 per gal Kunoco Oil for 235.98 per gal Motion by councilman Winters and seconded by Councilman Putney to accept the lowest bid from MX Fuels for 232.25 per gal of gasoline. Ayes -5 Nays- 0 D. Resolution # 6 of 2010 Be it resolved that the Town Of Lisbon hereby approve a penalty of $2.00 to be charged against each parcel requiring a second notice. Motion by councilman Winters and seconded by Councilman Putney to accept the Resolution # 6 to approve of attaching a penalty of $2.00 to each parcel for second notice mailed out. A verbal roll call was taken. Roll Call Vote: Supervisor: James Armstrong - Aye Councilman: Alan Dailey - Aye Councilman: Vincent Winters - Aye Councilman: C. Roger Shoen - Aye Councilman: Nate Putney - Aye E. Beach and Campground Fees - No Action Taken. F. Combined Water District Councilman Dailey made a motion and seconded by Councilman Shoen to send a check to Burley-Guminiak & Associates for $1000.00 in conjunction with the Village of Heuvelton, Town Of Oswegatchie and the Town Of Lisbon Combined Water District Grant. Ayes - 5 Nays - 0 G. Shooting Range Contract Supervisor Armstrong had a call from Susan Mc Lear on the shooting range contract with Correction Officers. Councilman Armstrong wants full responsibility for all law enforcement agencies using the shooting range. Supervisor Armstrong will get back to her, as the contract doesn't expire till May 2010. H. 18.8 acres Pray Road and County Route 10 Land Councilman Alan Dailey approached the Town Board about selling a 18.8 acre parcel of land near the Pray Road and CR 10. Deputy Supervisor Dailey brought the topic before his fellow board members after Supervisor James Armstrong informed the board that the Vermont Rail System, the company that operates the Ogdensburg Bridge and Port Authority - owned railroad, would not grant the town an easement to build a road that crosses the tracks. According to Mr. Armstrong Wade A. Davis, Executive Director of the Ogdensburg Bridge and Port Authority said the company would likely oppose even an emergency access road due to accidents that have occurred with the railroad in the past. Councilman Dailey said if the town cannot build a road on the land, he would like to see it put up for sale. I think the town should get back the money we have in it. No decision was made. The town paid $40,000.00 for it last year from Robin Moore. Councilman Winters said he believes Ms. Moore had "first refusal rights" on any sale of the property. If the town-owned plot is sold, the sale would be subject to permissive referendum. The board is expected to discuss the issue in April. Executive Session None 16.
