Councilman Dailey made a motion, seconded by Councilman Winters to appoint Alan Winney, PA for a 4-Year Term as Health Officer.   Ayes - 5       Nays - 0

•  Appointment for Representative for NYS Association of Towns

Councilman Winters made a motion, seconded by Councilman Shoen to appoint Councilman Alan Dailey to represent the Town of Lisbon for New York State Association of Towns.

•  Appointment of Deputy Animal Control Person - Jim Pipher

Councilman Dailey made a motion, seconded by Councilman Winters to appoint Jim Pipher as Deputy Animal Control Person.   Ayes - 5 Nays - 0

•  Appointment of Representative with the Lisbon Housing Authority - Margaret Backus.

Councilman Dailey made a motion, seconded by Councilman Winters to appoint Margaret Backus to the Lisbon Housing Authority ending December 2013.   Ayes - 5     Nays - 0

•  Appointment to the Planning Board for a 7-Year Term - Glenn Harris.

Councilman Dailey made a motion, seconded by Councilman Shoen to appoint Glen Harris to the Lisbon Planning Board ending December 2017       Ayes - 5          Nays - 0

      F.   Appointment to the Municipal Power (AMP) - Linda McQuinn with alternate Steven Jemison. Alternate Steve Jemison gave the board a summary of what AMP stands for and what is happening with AMP.

Councilman Dailey made a motion, seconded by Councilman Shoen to appoint Linda McQuinn to represent Lisbon for the Municipal Power with Steven Jemison as alternate.   Ayes - 5       Nays - 0

6.    Town Clerk Report November 2009

Councilman Winters made a motion, seconded by Councilman Dailey to approve the Town Clerk's Report for December 2009.   Ayes - 5           Nays - 0

7.   Approval of Town Justice Reports

Councilman Dailey made a motion, seconded by Councilman Winters to accept the Justice Reports for the month December 2009.   Ayes - 5     Nays - 0

8.       Recognition of Guest

•  Patrick Green - Questions the Fire District from last year to this year.   Since we had an increase last year, why didn't the Fire District go back down to the previous year amount?   Supervisor Armstrong stated that whatever the Fire District submits to the Lisbon Town Board is what they received from taxes.

Mr. Green stated that when he was in school that there was a Board of Supervisors and not Board of Legislators.   He felt that the government should return to that method and get rid of the Legislators and return to the Board of Supervisors to save expenses.   He stated that there are a lot of places with the county that could save on expenses and the town board should have a say in this matter.   Supervisor Armstrong stated that his intent is not to raise taxes and work with what we have. Supervisor Armstrong stated that his opinion is that before he would raise taxes he would cut somewhere to not raise them. Anything to do on the county level he would have to address Legislator Forsythe, as he is our county representative.

There was much discussion concerning equalization and taxes.

10. Approval of Supervisor Report

Councilman Dailey made a motion, seconded by Councilman Winters to approve the Supervisor Report. Ayes - 5 Nays - 0

11. Highway Superintendent Report

Highway Superintendent Dow informed the board that the Church Street Bridge will be removed between now and March 1, 2010.   Completion date is March 31, 2010.   Fiacco & Riley Construction was hired by the Bridge and Port Authority to remove the bridge.   They will be working from the railroad tracks and from Church Street.

Highway Superintendent Dow also informed the board that he might have to do a fuel bid by telephone before next meeting.

•  Resolution # 1 Holding Harmless the County of St. Lawrence for Providing/Services

from the Town of Lisbon

RESOLUTION # 1 of 2010

HOLDING HARMLESS THE COUNTY OF ST. LAWRENCE FOR PROVIDING SERVICE FOR THE TOWN OF LISBON

WHEREAS,             the Town of Lisbon is desirous of St. Lawrence County Department Highways providing shared services such as paving, shoulder widening, signage, road stripping, blasting and other routine maintenance actives to the Town, and

WHEREAS,             both the Town of Lisbon and the County of St. Lawrence are desirous of promoting partnering efforts for the safety of the traveling public in St. Lawrence County, and

WHEREAS,             in this joint cooperative endeavor, the Town of Lisbon and the County of St. Lawrence desires to be reimbursed for their expenditures, and

WHEREAS,             the Town is aware that the County may incur liability in the providing of the services and wishes to indemnify the County in this regard,

WHEREAS,             the Town has indicated an interest to participate in such an effort,

NOW THEREFORE, BE IT RESOVLED that the Town of Lisbon hereby agrees to defend, indemnify and hold harmless the County of St. Lawrence from and against liability, loss, damage, claim or action resulting from the work performed by St. Lawrence County Department of Highways.   The Town of Lisbon does not indemnify and hold harmless the County for any liability, loss, damage, claim, or action, which arises during actual performance of services by the St. Lawrence County Department of Highways. Said St. Lawrence County Department of Highways

and the County of St. Lawrence assumes the liability for losses, and claims for the actual physical performance of the work, and

BE IT FURTHER RESOLVED that the following request for General Liability (GL) coverage is as follows:

General Liability Insurance

On an "Occurrence" basis, with the following limits:

$1,000,000 Each Occurrence

$2,000,000 General Aggregate

$1,000,000 Aggregate

$1,000,000 Personal Injury

$      50,000 Fire Damage Legal Liability

$        5,000 Medical Payment Expense

BE IT FURTHER RESOLVED, that St. Lawrence County shall be an additional insured on the GL Policy, via ISO endorsement CG 2026.

Councilman Dailey made a motion, seconded by Councilman Winters to approve Resolution # 1 Holding Harmless the County of St. Lawrence for Providing/Services for the Town of Lisbon.

12. Report from Legislator

Legislator Forsythe informed the board and guests that he was completely against sales tax increase.   Legislator Forsythe said that he was also against increase on County tax.   He is in favor of cutting positions and no increase taxes. Councilman Dailey stated that he had spoke with the County Treasurer, who informed Councilman Dailey that the only places they could cut positions were with the Highway Department and Road Patrol.   Councilman Dailey found this to be incredulous. With that size budget, these were the only two places that could be cut. Legislator Forsythe fully agreed with Councilman Dailey. Legislator Forsythe stated that the Legislator Board wanted to cut budget without cutting positions.   Legislator Forsythe stated he could point out several positions that could be cut. He also stated that by cutting positions it was going to hurt. There was no way out of this. Once you have a position, then take it away, it is going to hurt. Legislator Forsythe stated that Highway is an easy target to cut, but you can't keep doing that, not with 600 miles of highway to cover. Sheriff patrol, this is the first place you call if need help.   Gary Madlin stated that there are more state troopers on the road than there ever were. Councilman Dailey stated that State Troopers couldn't transport prisoners, where the Sheriff can. Legislator Forsythe questioned why couldn't the Correctional Officer do the transporting, instead of paying overtime to the Sheriff?   He didn't have an answer for his own question. He also stated that he felt that the state would be closing Ogdensburg Correction Facility.   That will hurt Northern New York. His main statement was that you have to say NO to increases, as we can't afford them. The Legislators need to put their heads together and just think about what they are doing to help solve these problems.

Town Clerk McBath asked Legislator Forsythe what was happening with County Health Insurance? Legislator Forsythe felt we needed to get a grasp on Health Insurance before we can do anything with it.

13. Old Business

A.   Recreation building at the Fields and Friends Park

Water and Sewer for building - Town Clerk McBath inquired if the Highway Department was going to install the water and sewer to the building or would it have to be contracted out.   Highway Superintendent Dow stated that he spoke with Doug, who was going to meet with the Board Of Health to see if we could go with plastic instead of copper.   Doug would also clear it with the Board of Health to see if in a septic system could be installed instead of hooking into the Town Sewer Line, because of the elevation change from the building to the sewer line. So he is just waiting to hear from the Health Department.

14. New Business

•  Procurement Policy

Supervisor Armstrong asked for each board member that approves a purchase for a department or committee which is more than $250.00 the board member must initial the voucher that the approved it.

Councilman Dailey made a motion, seconded by Councilman Winters to approve the Procurement Policy with the exception of line 11, a $50.00 limit for purchasing except the Highway Department without approval of a board member.   It will state now: A $250.00 limit for purchasing by approval by a board member, except the Highway Department which does not require an approval of a board member.   Ayes - 5       Nays - 0

•  Finances with the Town

Supervisor Armstrong informed the board that the money, which was previously placed in the St. Lawrence Credit Union and the Stock Money Market, was illegal.   The money is now placed in a bank.   Supervisor Armstrong stated to the board that the law states that all municipal money has to be placed in a commercial bank.

Supervisor Armstrong informed the board that there is an audit in progress as Supervisor Armstrong felt that when administration changes, there should be an audit.

      B.       Highway Trucks and Equipment.

Supervisor Armstrong asked Highway Superintendent Dow why the Deputy Highway Superintendent was taking a town truck home with him at night.   Highway Superintendent Dow stated that in the morning, or when the highway department is called in on overtime, Deputy Highway Superintendent Trombley checks out the road conditions on one side of the township, while he (Highway Superintendent Dow) checks out the other side of town.   This saves the town money. If Deputy Highway Superintendent Trombley had to come into the garage to get the truck on call in bases, before going out on the roads, he would have to be paid three hours overtime before getting started.   With him using the truck we are not paying him until he reaches the garage.

Councilman Shoen made a motion, seconded by Councilman Dailey that no town equipment, parts, people, labor & etc. are to be used anywhere other that for town business.         Ayes - 5       Nays - 0

      C.   Wages for Town Supervisor, Councilman, Animal Control, and Deputy Town Clerk

Councilman Dailey questioned why these positions were cut in wages from the previous year.   He felt that the wages needed to be put back to original amounts that were in the 2009 budget year.   It would not be a raise, just the original amount.   Attorney Nash informed the board that a local law was needed to do this.   He recommended that the board wait for the audit to be completed before doing this.

Councilman Shoen made a motion, seconded by Councilman Dailey to have Attorney Nash to draw up a local law to bring back the budget pay of 2009 for the Town Supervisor, Councilman, Animal

Wages for Town Supervisor, Councilman, Animal Control, and Deputy Town Clerk

Control, and Deputy Town Clerk. The Public Hearing will be at 6:45 PM on February 10, 2010.                                                                      Ayes - 5       Nays - 0

•  Lisbon Beach

Town Clerk McBath informed the board that the people that took swimming lesson did not receive their American Red Cross swimming lessons certification cards.   The parents had paid for the children to take swimming lessons.   They should have received their certification card.   Town Clerk McBath asked if she could have someone check into this and find out who took the lessons and get their cards to them. The board gave full approval for Town Clerk McBath to look into this matter.

Gary Madlin inquired if anything could be done during summer season and off-season for dog owners could clean up after their dogs. Supervisor Armstrong stated that there should be signs up to clean after their dogs.                                        

15. Executive Session

Councilman Shoen made a motion, seconded by Councilman Winters to go into executive session to discuss a contract at 9:15 PM. Ayes - 5       Nays - 0

Councilman Dailey made a motion, seconded by Councilman Winters to return to the regular meeting at 9:35 PM.       Ayes - 5       Nays - 0

Councilman Winters made a motion, seconded by Councilman Daily to have Supervisor Armstrong speak with William Dishnaw to see if he would be interested in being a Financial Consultant for the Town of Lisbon. Ayes - 5 Nays - 0

16.       Adjournment

Councilman Dailey made a motion, seconded by Councilman Winters to adjourn the meeting at 9:40 P.M. Ayes - 5             Nays - 0
