BOARD MEETING

APRIL 8, 2009

LISBON TOWN HALL

Present: Supervisor Don Strader, Councilman Tom Schneller, Highway Superintendent Timothy Dow Councilman Vincent Winters, Town Clerk Donna McBath, Councilman C. Roger Shoen, Attorney Charles Nash, esq.                                          

Guest:   Approximately 100 to 150 people

1.    Meeting Called to Order

      Supervisor Don Strader called the meeting to order at 6:05 PM.

2.    Minutes Approvals

•  March 11, 2009

Councilman Schneller made a motion, seconded by Supervisor Strader, to approve the meeting minutes of March 11, 2009. Ayes - 4 - Nays - 0    

3.    Town Clerk Report for February and March 2009

Supervisor Strader noted the Homecoming Committee made $2998.00 at the Donkey Basketball Game.

Councilman Schneller made a motion, seconded by Supervisor Strader to approve the February Town Clerks Report. Ayes - 4 - Nays - 0

Supervisor Strader made a motion, seconded by Councilman Winters to approve the March 2009 Town Clerk's Report.                                                                         Ayes - 4           Nays - 0

  4.   Approval of Town Justice Reports

Supervisor Strader made a motion, seconded by Councilman Winters to accept the Justice Reports for the month March 2009. Ayes - 4 - Nays - 0

5.       Recognition of Guest

      Approximately 125 people were in attendance to express their concerns on the new assessments

      that were done by the assessor.   Supervisor Strader, Councilmen Schneller, Winters, and Shoen

      and Attorney Nash fielded their questions.

Supervisor Strader made a motion, seconded by Councilman Winters for Supervisor Strader and Councilman Schneller to approach Assessor Green to ask him to return the assessments back to the 2008 assessment roll. Supervisor Strader informed the public when we are assessed at 85%, the county will raise it for equalization throughout the township for the county. The Town of Lisbon doesn't do it.

Denise Morley wanted to know when the Lawrence Road was going to be repaired, as there are several large holes.   Highway Superintendent Dow did not know anything about it, but would check into it and get it repaired.

6.    Approval of Abstracts

Councilman Winters made a motion, seconded by Councilman Schneller to approve the abstracts from March 2009.

7.    Approval of Supervisor Report

Councilman Schneller made a motion, seconded by Councilman Winters to approve the Supervisor Report. Ayes - 4 - Nays - 0

The meeting was put on hold so it could be moved down to the Conference Room at approximately 7:40 PM.

The meeting started again at 8:10 PM in the Conference Room

8.    Highway Superintendent Report

Highway Superintendent Dow would like to schedule a road trip with the Town Board to look at the roads for general repair. It was agreed that they would meet on May 13 at 7:30 AM.

Sheehan received the lowest State quote for black topping.   Highway Superintendent Dow felt there was a conflict of interest.

Attorney Nash wanted to inform the board, that he is also the attorney for Sheehan.  

Blacking Topping is cheaper to be purchased from Sheehan, and have them draw it. Therefore the town has the obligation to use Sheehan.   There is going to be a time when he can't supply the product, as he will be in demand.   Can we still purchase it from someone else?   Attorney Nash informed Highway Superintendent Dow, that they could. But we need to think of the taxpayers.  

Contract for the Union:   Highway Superintendent Dow stated that he looked it over along with the union. Attorney Nash asked if everyone had looked the contract over.

9.    Old Business

      A.       Appointment for New Member for Assessment Review Board      

Supervisor Strader made a motion, seconded by Councilman Schneller to appoint John Gardner to the Assessment Review Board. Ayes - 4 - Nays - 0

10. New Business

•  Tax Second Notice of $2.00

Supervisor Strader made a motion, and was seconded by Councilman Schneller, to approve a penalty of $2.00 to be charged against each tax parcel requiring a second notice.            

•  Bid Opening for Rental Property on Pray Road

Teele Farm - $503.00 per year

Woodcrest Dairy LLC - $650.00 per year

Lisbon Fire Department Offered - willing to pay a reasonable price per acre for the use of this land, or match the highest reasonable bid.

Supervisor Strader made a motion, and was seconded by Councilman Schneller, to reject all bids for the rental of the property on Pray Rd. Ayes - 4                   Nays - 0

Councilman Schneller recommended that this issue be tabled until May 13th meeting.

C.   Resolution # 6 Holding Harmless the County of St. Lawrence for Providing Services

In front of the Fire Department there is a catch basin.   When the new fire hall addition was built, the contractor plumed into the county catch basin. Two weeks ago, during a fire, the catch basin caved in. The county doesn't want to take responsibility because there was no permit issued for the contractor to attach into this catch basin for the drains from the Fire Department. The County is requesting that the board pass this resolution.

RESOLUTION #6 of 2009

Holding Harmless the county of St. Lawrence

for providing service for Lisbon       

WHEREAS, the Town of Lisbon, is desirous of having St. Lawrence County provide stormwater and subsurface water collection into St. Lawrence County's catch basin along County Route 10 for Town of Lisbon's Fire District, and

WHEREAS , both the Town of Lisbon and the County of St. Lawrence are desirous of promoting cooperation for the safety of the traveling public in St. Lawrence County, and

WHEREAS , the Town is aware that the County may incur liability in the providing of the services and wishes to indemnify the County in this regard,

NO, THEREFORE, BE IT RESOLVED THAT THE Town of Lisbon hereby agrees to defend, indemnify and hold harmless the County of St. Lawrence from and against any and all liability, loss, damage, claim or action, to the extent permissible by law, arising out of operations performed or services provided by St. Lawrence County Department of Highways.

The board asked Attorney Nash if they should sign the resolution.   Highway Superintendent Dow stated if we do sign it, then we will own the catch basin. The board has decided to table this resolution so Attorney Nash can research it.

D. Supervisor Nash asked if quotes or bids should be requested for Sparrow Hawk that was given back to the Town from the Power Authority.   He suggested that the town could either place an ad for sealed bids or place it into the hands of a broker. Councilman Schneller suggested that we get it appraised this spring, then place it into the hands of a broker.

Councilman Winters made a motion, seconded by Councilman Shoen to approve Supervisor Strader to have the land appraised. Ayes - 4 - Nays - 0

D.   Placing Nicole Barr's name on the Smith Barney account.

Supervisor Strader made a motion, seconded by Councilman Winters to approve placing Nicole Barr's name on the Smith Barney account. Ayes - 4 - Nays - 0

E.    Lisbon Medical Group Building

Highway Superintendent Dow stated that the roof of the Lisbon Medical Group Building is missing many shingles.   He stated that a new roof is needed.   Supervisor Strader stated that the Medical Group Building account has $32,000 in it. Supervisor Strader said he would investigate to determine if it just needed to be repaired or if it needed a new roof.   If the roof does need to be repaired, Supervisor Strader requested permission to put it out for bids.

Legal Notice

Pursuant to Section 103 of the General Municipal Law, State of New York, Sealed bids will be received at the Town of Lisbon, Lisbon Town Hall, Lisbon, New York 13658 until 4:00 P.M., Tuesday, May 12, 2009. At which time and place, they will be opened on Wednesday, May 13, 2009 and read aloud for the purchase of a new roof for the Lisbon Medical Group Building.

Following items:

1.    Replace shingle roof on Lisbon Medical Group Building roof approximately 34' x 48' along with an entrance of 10' x 7' with 30-year architectural shingles - Match 30 lb felt paper.   The roof is to be stripped and the Town Highway Department will remove all debris.

2.    Repair any bad spots that are in all roofs.

Price 30 Days from Delivery signature.

All bids must be accompanied by a non-collusion statement.   The Town of Lisbon reserves the right to reject any/or all bids.   Please place the bid in a sealed envelope and mail or deliver to the: Town of Lisbon, Lisbon Town Clerk Office, Lisbon Town Hall, P.O. Box 98, Lisbon, New York   13658

Councilman Schneller made a motion, seconded by Councilman Winters to approve Supervisor Strader to inspect the Medical Group roof to see if it needs to be repaired or replaced.   If replacement is needed then place it out for bid. Ayes - 4 - Nays - 0
