TOWN OF LISBON LOCAL LAW # 1 FOR 2009 EXEMPTION FROM TAXATION FOR CERTAIN SOLAR OR WIND ENERGY SYSTEM MARCH 11, 2009 6:00 PM Present: Supervisor Don Strader, Councilman Tom Schneller, Highway Superintendent Timothy Dow, Councilman Vincent Winters, Deputy Town Clerk Emily Grant, Attorney Charles Nash, esq. Absent: Town Clerk Donna McBath, Councilman C. Roger Shoen Guest: Brian Dezell, Wes Pike, Patrick Green, Bruce Green, Steve Teele, Jane Powers, Jimmy Lawton - Ogdensburg Journal 1. Meeting called to order by Supervisor Don Strader at 6:00 PM. 2. Pledge Allegiance 3. Discussion Supervisor Strader asked for Attorney Nash to explain the Local Law # 1 of 1999 and Local Law # 1 of 2009. Attorney Nash stated in 1991 the stated passed an exemption for solar and wind energy. The town decided not to grant that exemption, because they wanted full value if any solar or wind energy was built. So the board decided to opt out this exemption. The law that is being presented would basically wipe out the opt out position and go back to the 1991 law as the state has it, so the people can get the exemption for wind and solar energy. Attorney Nash recommends that the Lisbon Town Board pass the law so that they can get back to the state law that allows the exemption to be granted. Steve Teele- Mr. Teele, in regards to Town of Lisbon Local Law #1 For 2009 Exemption From Taxation For Certain Solar Or Wind Energy System, stated that he had seven solar exemptions, as personal solar exemptions in Canton. This meant that the owner was exempted of what it adds to the value of the property. Jane Powers- Ms. Powers, Director of Real Property, discussed the 2009 level of assessment and equalization rates for the town of Lisbon. She also explained what the town of Lisbon Local Law #1 for 2009 Exemption From Taxation For Certain Solar Or Wind Energy System meant. Regarding town assessments, the property tax law common date to measure the full value of property is July 1, 2008. Wes Pike- Mr. Pike asked if the recent decrease in market value would have an affect on this year's assessment. Ms. Powers stated things that have happened since July 1, 2008, will be reflected on the following year assessments. 4. Adjournment Supervisor Strader made a motion, seconded by Councilman Schneller to adjourn the meeting at 6:30 PM. Ayes - 3 Nays - 0 Gouverneur |
