TOWN OF LISBON BOARD MEETING MARCH 11, 2009LISBON TOWN HALL Present: Supervisor Don Strader, Councilman Tom Schneller, Highway Superintendent Timothy Dow, Councilman Vincent Winters, Deputy Town Clerk Emily Grant, Attorney Charles Nash, esq. Absent: Town Clerk Donna McBath, Councilman C. Roger Shoen Guest: Brian Dezell, Wes Pike, Patrick Green, Bruce Green, Steve Teele, Jane Powers, Jimmy Lawton - Ogdensburg Journal 1. Meeting Called to Order Supervisor Don Strader called the meeting to order at 6:15 PM. 2. Minutes Approvals A. February 11, 2009 Supervisor Strader made a motion, seconded by Councilman Winters, to approve the meeting minutes of February 11, 2009. Ayes - 3 Nays - 0 3. Approval of Town Justice Reports Councilman Schneller made a motion, seconded by Councilman Winters to accept the Justice Reports for the month of January 2009. Ayes - 3 Nays - 0 4. Recognition of Guest Jimmy Lawton-Represented the Ogdensburg Journal Newspaper Pat Green- Regarding Resolution #4 of 2009, He stated that he had found that the Town of Lisbon is not a member of the St. Lawrence River Valley Agency. He wanted to know why? Mr. Green stated that he would like to have the resolution reworded to say that some of the extra power that Lisbon would receive could be sold by the Town of Lisbon to communities off the river, thereby putting the money back into the local economy. Supervisor Strader stated Mr. Green's suggestion could not be put into the resolution, as we need to work, as a group not as a signatory town. Mr. Patrick Green also stated that he had been informed that tiled ground was considered a capital improvement. He questioned why couldn't it be assessed as such. Assessor Mr. Bruce Green informed him that according to state regulations, the state required the town to place a ceiling on certain types of certain soils. They are unable to assess more than that cap. Bruce Green- Mr. Green stated that relating to reval, things were pretty much on schedule. The Town Board members should expect phone calls from concerned people. Those individuals should be forwarded to him. The Town Board needs to be united as we go through this time period. His focus is to bring the assessments in line with the market value. Brian Dezell- Just present to listen Jane Powers - Real Property Office - 5. Approval of Abstracts Councilman Tom Schneller made a motion, seconded by Councilman Vincent Winters to approve the abstracts from February 2009
Ayes- 3 Nays - 0 6. Approval of Supervisor Report Councilman Winters made a motion, seconded by Councilman Schneller to approve the Supervisor Report. Ayes - 3 Nays - 0 7. Highway Superintendent Report A. Resolution # 5 - New York State Department of Transportation RESOLUTION #5 of 2009 Town of Lisbon NEW YORK STATE DEPARTMENT OF TRANSPORTATION WHEREAS, the town of Lisbon from time to time receives permits from New York State Department (NYS DOT) to temporarily obstruct, install, construct, maintain, operate or replace any facilities within the bounds of a state highway right-of-way, and WHEREAS, the town is required by NYS DOT to indemnify or hold harmless agencies and/ or officials of the State of New York for such temporary obstructions, installations, construction or maintenance, THEREFORE be it resolved that Supervisor Donald Strader is authorized to execute any undertaking in connection with highway permits issued by NYS DOT agreement. Supervisor Strader made a motion, seconded by Councilman Schneller to accept Resolution # 4 of 2009 New York State Department of Transportation Roll call vote was taken: Councilman Winters - yes, Supervisor Strader - yes, Councilman Schneller - yes, Councilman Shoen - Absent Ayes - 3 Nays - 0 Supervisor Strader informed the board that Highway Superintendent Dow would have a road improvement schedule for the next meeting. 7. Old Business A. Local Law No.1 for 2009 Solar and Wind Energy Exemption Supervisor Don Strader made a motion, second by Councilman Tom Schneller to enact the Local Law # 1 of 2009 exemption from taxation for certain Solar or Wind Energy system. Ayes - 3 Nays - 0 B. Appointment for Member for Assessment Review Board Supervisor Strader stated this was dealt with at the February meeting, to appoint John Gardner for the Assessment Review Board. 8. New Business A. Campground Fees -The Board discussed the proposed campground fees and increases, as submitted by Mr. Mike O'Neil. Ayes - 3 Nays - 0 C. Resolution # 4 - St. Lawrence Valley Redevelopment Agency Discussion was done with the agreement on there would be 4 signatory town (Town of Lisbon, Lewisville, Massena and Waddington) and 1 County Representative. All town board members were in agreement. RESOLUTION #4 of 2009 Town of Lisbon, St. Lawrence River Valley Agency WHEREAS, the Town of Lisbon, located in the County of St. Lawrence and State of New York, was signatory to a certain agreement between the said Town and the New York Power Authority dated the 22 day of February, 2002, and WHEREAS , the New York Power Authority has certain additional assets for the benefit of the NYPA host communities; and WHEREAS , it has been proposed that the host communities form the St. Lawrence River Valley Redevelopment Agency to use those additional assets from the New York Power Authority to engage in infrastructure development to promote economic development; it is therefore, RESOLVED , that the Town of Lisbon in the County of St. Lawrence and State of New York hereby approves the St. Lawrence Rive Valley Redevelopment Agency Agreement; and it is further, RESOLVED , that the Town Supervisor/ Mayor is authorized to sign the said St. Lawrence River Valley Redevelopment Agency Agreement to bind the said Town of Lisbon in accordance with the terms of that agreement. Emily Grant, Lisbon Deputy Town Clerk Supervisor Strader made a motion, seconded by Councilman Schneller to accept Resolution # 5 of 2009 St. Lawrence River Valley Redevelopment Agency Agreement. Ayes - 3 Nays -0 B. Pray Road Land Discussion was held concerning the leasing of the land purchased on the Pray Road to farmers. Topics that were explored were the length of time for the lease; how to terminate the lease; what the land can and cannot be used for; what can be spread on the land; how much termination notice should be given; which party would provide the insurance; if only lease to a farm; and what agricultural crops would be accepted. Supervisor Don Strader requested Attorney Charles Nash to write something up to present to the board, regarding the lease agreement. The option to accept or reject the lease would still be up to the discretion of the board. C. Power Authority Land The members of the board requested Attorney Nash to write a letter to Sean Doyle (NYS Power Authority) and ask him to write a letter to the land owners that have not purchased the land that borders them. Mr. Doyle is to give them 30 days to answer to him on their intent concerning the land. In the original agreement the landowners had 2 years to make a decision on whether or not they wanted to purchase the land that was owned by the Power Authority that bordered the landowners. That agreement of 2 years has expired. If the landowners were not interested, it was to be sold back to the Town, who could purchase it for $1.00 each. 12. Executive Session There was not executive session 13. Adjournment Supervisor Don Strader made a motion, seconded by Councilman Tom Schneller to adjourn the meeting at 7:14 P.M.
