BOARD MEETING

FEBRUARY 11, 2009

LISBON TOWN HALL

Present: Supervisor Don Strader, Councilman C. Roger Shoen, Highway Superintendent Timothy Dow, Councilman Vincent Winters, Town Clerk Donna McBath, Attorney Charles Nash, esq.                                          

Absent: Councilman Tom Schneller

Guest: Doug Smith, Legislator David Forsythe, Patrick Green, Richard Barkley, Josephine Skiff, Larry Trombley

1.    Meeting Called to Order

Supervisor Don Strader called the meeting to order at 6:04 PM.

2.    Minutes Approvals

A.   January 14, 2009

Supervisor Strader made a motion, seconded by Councilman Winters to approve the meeting minutes of January 14, 2009.       Ayes - 3       Nays - 0

3.    Approval of Town Clerks Report

Councilman Winters made a motion, seconded by Councilman Shoen to approve the Town Clerk's Report for the month of January 2009   Ayes - 3       Nays - 0

4.    Approval of Town Justice Reports

Councilman Shoen made a motion, seconded by Councilman Winters to accept the Justice Reports for the month of January 2009.   Ayes - 3       Nays - 0

5.       Recognition of Guest

•  Larry Trombley - Mr. Trombley asked if the contract had been looked at by Attorney Nash and signed.   Attorney Nash stated he had not been given anything to look at. Supervisor Strader stated that he would look into it on Thursday.

•  Pat Green - Mr.Green asked that since Governor Patterson has asked union representatives to re-negotiate their contract, was the Lisbon Highway Department going to re-negotiate their contract with the town?   Supervisor Strader said that was not possible, as it was done last year.

Mr. Green also asked since homes are not worth as much as in the past, he would the assessment in the reval be reduced?   Supervisor Strader could not speak for the assessor Bruce Green, but he felt that, the assessment would not be lowered.

Mr. Pat Green also had concerns concerning tile drainage on fields.   He needed to get some answers and wanted to know where he should get them.   Supervisor Strader informed him that his State Senate and State Assembly should be able to give him the answers.

Richard Barkley, Vice President of the Library Board, wanted to know if it was possible to amend the budget so the Library Assistant/Substitute could receive more hours than she is receiving.   They would like the budget line 7412.1 be increased from $2,000 to $6,500.

Josephine Skiff, asked for the same as Richard Barkley.

Legislator Dave Forsythe wanted to know if the position was going to be filled for the councilman seat that was just recently vacated.   He informed the board that his father, Donald Forsythe, would be interested in the position.   Supervisor Strader informed him that he was looking into saving money, and not fill the position until January after the election, if it was possible.

Lloyd Driscoll inquired what needed to be done to have a sewer line run to his house in the village of Lisbon. Highway Superintendent Dow informed him that there is a take off at main sewer line that residents could hook into. He would need to hire a license contractor to put the sewer line into his house.   Mr. Driscoll then asked what needed to done in order to get water into the house again.   He was informed to talk with Doug Smith concerning getting the water turned back on, and the piping readjusted.

Mr. Driscoll also asked if there could be anything done concerning the speed limit on the corner of the Pray Road and Five Mile Line Road.   He knows there are a suggested speed limit, but nobody fellows that limit.   Mr. Driscoll stated that it's a very dangerous corner. Someone else is going to get hurt there in the future.   Highway Superintendent Dow stated that the county and state highway departments checked into this situation, and felt there was nothing that could be done.

6.    Approval of Transfers

Councilman Winters made a motion, seconded by Councilman Shoen approve the transfers for January 2009.

7.    Approval of Abstracts

Councilman Winters made a motion, seconded by Councilman Shoen to approve the abstracts from January 2009 with the exception of Dog Control.

8.    Approval of Supervisor Report

Councilman Shoen made a motion, seconded by Councilman Winters to approve the Supervisor Report. Councilman Winters brought to the attention to Supervisor Strader that the amount for Dog Control should be removed from this report since the voucher was not going to be paid.

9.    Highway Superintendent Report

Highway Superintendent Dow informed the board that Governor Patterson was lowering the CHIP allowance in the 2009 budget.   He requested that the Supervisor and Councilmen write a letter to our State Senate stating that they do not agree with the proposed state budget, as the Lisbon Highway Department constructed its budget including money received CHIP's. Supervisor Strader asked how much the town would be losing.   Highway Superintendent Dow stated that the loss would be $97,000.

10. Old Business

A.   Local Law for Solar and Wind Energy Exemption

The county is offering an exemption for solar and wind energy. The Town of Lisbon wants to offer this exemption to the Lisbon residents.   The exemption would include newly constructed solar panels and windmills.   A public meeting will be held for the Local Law on March 11, 2009 at 6:00 PM.

11. New Business

A.       Campground Director

Supervisor Strader made a motion, seconded by Councilman Shoen to approve hiring Mike O'Neil as Campground Director for the sum of $13,000.00.

B.   Code Inspections

Supervisor Strader wanted to inform the board that Code Enforcement Ray LaRock wanted them to consider inspections on businesses, apartment buildings, and any building that people gather for a meeting, etc. He would like to charge if a third visit is required on a violation. Town Clerk McBath asked, "Isn't the first visit already a charge?"   Supervisor Strader didn't know, but would look into it.   This will be discussed at the March meeting.

C.       Resignation of Councilman Collins

Supervisor Strader made a motion, seconded by Councilman Shoen to approve the resignation of

C. Joseph Collins with regards.   Ayes - 3 Nays - 0

D.   New Retirement Rules

All elected officials and appointed official's that are in the retirement system, will need to fill out a time sheet to see if they work at lease 6 hours a day in order to received a day from the retirement system. The government is investigating to see that all employees are receiving the correct amount of time from the retirement system.

E.    Budget Modification for Assistance/Substitute for Hepburn Library

Councilman Shoen made a motion to approve the budget modification for the Librarian Assistant/ Substitute.   There was no second, so the motion was not passed.

F.    Deputy Town Clerk

Supervisor Strader made a motion, and seconded by Councilman Shoen to approve hiring Emily Grant as a temporary Deputy Town Clerk while Donna and Eileen McBath are away.

13.       Adjournment

Supervisor Strader made a motion, seconded by Councilman Shoen to adjourn the meeting at 6:40 P.M.   Ayes - 3             Nays - 0
