TOWN OF LISBON TOWN BOARD MEETING October 8, 2008 6:00 PM Present: Supervisor Don Strader, Councilman C. Joseph Collins, Town Clerk Donna McBath, Councilman Tom Schneller, Attorney Charles Nash, esq., Councilman C. Roger Shoen, Highway Superintendent Timothy Dow, Councilman Vincent Winters Guest: Matt McAllister - Ogdensburg Journal, Max Mitchell - Watertown Times, Stephen & Connie Bonno, Richard Stemples 1. Meeting Called to Order Supervisor Don Strader called the meeting to order at 6:05 PM. 2. Pledge Allegiance 3. Minutes Approvals September 10, 2008 Councilman Schneller made a motion, seconded by Councilman Shoen to approve the meeting minutes of September 10, 2008 Ayes - 5 Nays - 0 4. Approval of Town Clerks Report Councilman Collins made a motion, seconded by Supervisor Strader to approve the Town Clerk's Report for the month of September 2008 Ayes - 5 Nays - 0 5. Approval of Town Justice Reports Councilman Schneller made a motion, seconded by Supervisor Shoen to accept the Justice Reports for the month of August 2008. Ayes - 5 Nays - 0 6. Recognition of Guest Matt Mitchell - Watertown Times - No Comment Matt McAllister - Ogdensburg Journal - No Comments Stephen Bonno - Mr. Bonno gave a paper to the Lisbon Town Board and Highway Superintendent stating "At this time we feel it is important for us to rescind our permission of the use of our turnaround for all town trucks and equipment." Signed by Stephen Bonno and Connie Bonno. Mr. Bonno had questions concerning the abandon closing of the part of the Maple Ridge Road that took place July 11, 2001. First, he asked what kind of problems did Highway Superintendent Dow have with himself (Mr. Bonno). Mr. Bonno stated that when Superintendent Dow wanted that road closed Mr. Bonno asked Attorney Nash whom does the road belong to now. Attorney stated at that time that the land would go back to the landowners on both sides of the road. (Which Attorney Nash agreed with him). Superintendent Dow stated that he was not out to get Mr. Bonno. Superintendent Dow stated that there was a public hearing for the closure of this section of the road and stated that Mr. Bonno had nothing to say at that public hearing. Mr. Bonno stated that he and Superintendent Dow had a conversation in Mr. Bonno's dooryard. Superintendent Dow stated that conversation was no go and he needed to state his concerns at the public hearing. The road was closed legally. Mr. Bonno asked if Superintendent Dow had measured the mile from the center of the Y at the Fulton road to where it ended at Bonno's. Superintendent Dow stated that he and Supervisor Strader had measured it with the odometer from a vehicle. Superintendent Dow stated the mile ended beyond Mr. Bonno's residence. Mr. Bonno's stated that it ended where his milk house is at the barn. Supervisor Strader stated, "The question is where the town road ends." Mr. Bonno stated that he had his land surveyed, but didn't have it completed at this time. He would forward it to the Planning Board when he receives it. Supervisor Strader stated that he and Superintendent Dow were at Mr. Bonno's residence today, and regretted that he had missed Mr. Bonno. Mr. Bonno stated that any conversation needed to be directed to Stephen in the future. Supervisor Strader asked for comments from Attorney Nash. He read the document that he had written "Commencing at a point, which is one mile from the intersection of Fulton Road and Maple Island Road and proceeding generally easterly 6/10 mile." The abandonment is 1 mile from the center of the Fulton Road onto the Maple Island Road. The discussion was put on hold until a county person could meet with Superintendent Dow and a representative for Mr. Bonno since Mr. Bonno had to be at work to measure the road. Nothing could be done until the measurement is done. He also stated that the turnaround has been revoked. 7. Approval of Transfers Councilman Schneller made a motion, seconded by Councilman Winters to approve the transfers for August 2008. Transfer $10,000.00

Ayes - 5 Nays - 0 8. Approval of Abstracts Councilman Schneller asked if the problem Recreation Committee had with Lowes has been resolved. Supervisor Strader said he had received the paper work today. Town Clerk McBath informed the board that there was thirty-eight dollars balance, which was put on a gift card. When Scott needs anything from Lowes, the gift card would be sent with him. Councilman Schneller made a motion, seconded by Councilman Winters to approve the abstracts from August 2008.
Ayes - 5 Nays - 0 9. Approval of Supervisor Report Councilman Winters made a motion, seconded by Councilman Shoen to approve the Supervisor Report. Ayes - 5 Nays - 0 10. Report from Legislator Forsythe Was not in attendance. 11. Highway Superintendent Report In the future the board will need to transfer funds of $13,000.00 from 5120.4 Bridges CE to 5142.4 snow removal. Superintendent Dow stated that he hadn't ordered any salt yet. The amount that is being transferred will only buy 150 ton out of his 600 tons that is ordered. The remaining of the salt will need to be bought on next year's budget. This will help get the sand pile started. The remaining will have to wait until next year. Superintendent Dow stated that in the past the board had discussed a new loader. He had received quotes from Caterpillar and Case. The price will be good with Caterpillar as long as the machine is at one of the stores. If it isn't on the premises, there will be an increase for the 2009 machine. Case Company guarantees the price until the end of the month. With trying to reduce the budget for 2009 the Machinery line 5130.2 cut down, as Superintendent Dow doesn't foresee that any other large equipment will be needed for the next couple of years. Superintendent Dow stated that we should go out for bid as the state bid may be better than they have already received. If anything is going to be done, it should be done now, as the price will be changing at the beginning of November. The machines that we have now are in very much need of expensive repairs. He questioned whether it is better cost effective if we purchase new equipment or repair the old equipment. Superintendent Dow stated that by putting the old machines that we have out to bid, it might be worth it to the companies that are bidding as they may give us a better price for trade ins. Town Clerk McBath asked when would the deadline be for the bids to be returned to her. The board decided to have a meeting on October 22, 2007 for a budget meeting and discuss the highway funds. It was suggested that it be put out to other bidders for used equipment. It would be advertised Sunday, October 12 th , Wednesday, October 15 th , and Sunday, October 19 th . Superintend Dow asked for Town Clerk McBath to fax out quotes for 1500 gallons of gasoline. She received back only one quote out of four requests. Griffith Energy quoted $2.5970 base. Councilman Winters made a motion, seconded by Supervisor Strader to approve the quote from Griffith Energy for 1500 gallons of gas. Ayes - 5 Nays - 0 12. Old Business A. Appointments for Assessment Review Board Supervisor Strader asked if there were any recommendation for the replacement of Steve Wallace for the Assessment Review Board. Supervisor Strader stated that Jeff Houmiel was the only one that was interested. Councilman Schneller made a motion, seconded by Supervisor Strader to nominate Jeff Houmiel to replace Steve Wallace position on the Assessment Review Board. Ayes - 5 Nays - 0 B. Planning Board Member Councilman Collins made a motion, seconded by Supervisor Strader to nominated Bill O'Leary to the Planning Board, who will be replacing Mike Duprey's position. 13. New Business A. Beach - Roof Replacement Large and Small Pavilion and Life Guard Building are in need of replacing the roofs. Town Clerk McBath asked the board if the job is to be completed this year or held over until next year. Supervisor Strader stated that if a bid is accepted, and if we have the money in the budget, it will be done this year. Town Clerk McBath asked if it is be to quoted to be one complete job or priced out separate for each roof. The board would like to have it bid out both ways. Town Clerk McBath stated that the legal notice was in the board members' folders, and asked if there were any additions or deletions. Councilman Schneller asked if there was a Certificate Insurance requested at the time of the bid. It was also stated that there should be. Supervisor Strader made a motion, seconded by Councilman Winters to put the bids out to replace the roofs on the two pavilions and building. Ayes - 5 Nays - 0 Councilman Schneller questioned if there was a particular shingle that needed to be put on. Town Clerk McBath stated that it should be a 30-year architectural shingle with matching brown 15 pound felt paper. Mike O'Neil, Campground Director, requested that the existing roof not be removed, and new-shingled roof be laid over it. The board requested that the last sentence be removed and changed to old shingles are to be stripped. The contractor is to repair any bad spots on the roof.
RESOLUTION # 14 of 2008NORTH COUNTRY LIFE FLIGHT WHEREAS, North Country LIFE FLIGHT, Inc. is a not-for-profit, tax-exempt corporation which is responsible for all aspects of patient care by providing medical equipment, training medical personnel and administering the medical portion utilizing the New York State Police helicopter based in Saranac Lake and private fixed-wing aviation resources; and WHEREAS, The New York State Police and private fixed-wing aviation resources do not provide a medically trained team or medical equipment for patient transports; and WHEREAS, The people of Clinton, Essex, Franklin, Hamilton and St. Lawrence Counties receive a vital emergency medical service which is free of charge to critically ill and seriously injured patient, and, therefore municipal governments are asked to pledge monies for this worthwhile program; NOW, THEREFORE, BE IT RESOLVED: That the Town Board of the Town of Lisbon hereby authorizes the Supervisor to enter into a contract with North Country LIFE FLIGHT, Inc. for the purpose of operating the medical component of the medivac program, which will serve its residents and visitors, and paying the amount of $100.00 which represents the Town's share of 2008; and be it FURTHER RESOLVED: The sum of $100.00 is herby appropriated to Account No. 4010.4 for payment to North Country LIFE FLIGHT, Inc. Water & Sewer Relevies Councilman Schneller made a motion, was seconded by Supervisor Strader, to transfer all Water and Sewer Relevies to the County to be placed on the 2009 County and Land Taxes. Ayes - 5 Nays - 0 D. Union Contract Councilman Winters made a motion, was seconded by Councilman Shoen to approve Supervisor Strader to sign the CSEA Union Contract as is. Aye - 5 Nays - 0 E. Steve Bonno - Road Closing This was discussed in Recognition of Guest. Supervisor Strader asked Superintendent Dow on how he was going to turn the plow around safely. It will be decided at a later date on how the turn around will be done safely. F. Work Session on Budget was done earlier in the meeting. G. Library The librarian has resigned and Supervisor Strader wanted to know who hires the new librarian the Town Board or the Library Board. Attorney Nash stated that the board has no right to hire anyone, but he would look further in the law and see what it stated. Barbara Shoemaker, president of the Library Board, stated that if there were any further problems the people are to address the Library Board, not the Town Board. The Town Board agreed with this matter. 14. Executive Session No Executive Session 15. Adjournment Councilman Schneller made a motion, seconded by Councilman Shoen to adjourn the meeting at 7:45 P.M.
