TOWN BOARD MEETING

July 9, 2008

6:00 PM

Present:             Supervisor Don Strader, Councilman C. Joseph Collins, Highway Superintendent Timothy Dow, Councilman Tom Schneller, Town Clerk Donna McBath, Councilman C. Roger Shoen, Attorney Charles Nash, esq., Councilman Vincent Winters

1.       Meeting Called to Order

Supervisor Don Strader called the meeting to order at 6:00 PM.

2.    Pledge Allegiance

•  June 11, 2008

Councilman Schneller made a motion, seconded by Councilman Winters to approve the meeting minutes of June 11, 2008.                         Ayes - 5       Nays - 0

                        June 26, 2008 - Special Meeting

Councilman Collins made a motion, seconded by Councilman Shoen to approve the special meeting minutes of June 26, 2008.             Ayes - 5       Nays - 0

4.       Approval of Town Clerks Report

Councilman Schneller questioned Town Clerk McBath regarding the Donkey Basketball Game:   why $390.00 was returned to people who purchased basketball tickets refunding when only $275.00 was collected from ticket sales in the month of June.   Town Clerk McBath said she did not have an answer at this time, but would look into it.

Councilman Schneller made a motion, seconded by Councilman Collins to approve the Town Clerk's Report for the month of June 2008 with the exception of the discrepancy of the Donkey Basketball Game.                                 Ayes - 5       Nays - 0

5.       Approval of Town Justice Reports

Councilman Schneller made a motion, seconded by Councilman Winters to accept the Justice Reports for the month of June 2008.                    Ayes - 5     Nays - 0

6.       Recognition of Guest

No guests were in attendance.

7.       Approval of Abstracts

Councilman Collins made a motion, seconded by Councilman Winters to approve the abstracts from June 2008.

8.       Approval of Supervisor Report

Councilman Collins made a motion, seconded by Councilman Winters to approve the Supervisor Report.                                                Ayes - 5       Nays - 0

9.    Report from Legislator Forsythe

Legislator Forsythe was not in present.

•  Highway Superintendent Report

•  Black Topping had increased another $8.00 a ton, which would total $56.00 a ton for the month of July.

•  Price for loaders

Highway Superintendent Dow priced a new loader with a trade in:

      Monroe Tractor       Trade 1999 Caterpillar for a Case Loader would be $67,740.60

                                    Trade 1989 Caterpillar for a Case Loader would be $83,032.68

            This is a quote from State Bid.

      Milton Caterpillar did not price it out.

Option would be putting the two caterpillar loaders out for bid to the public to see if there would be much difference.

The Board asked for Highway Superintendent Dow to contact Monroe for a lease contract to see what it would cost the town.

            This subject was tabled until September or October.

•  Dumpster at beach.   Highway Superintendent Dow stated that it saves the town money owning the dumpster at the beach, compared to contracting it out.   The main problem is that Superintendent Dow and his crew have received calls at home to have the dumpster emptied.

A.       Workplace Violence Program - Attorney Nash informed the board that they have to have in place a Workplace Violence Program policy on Workplace Violence.   He has a policy that he would like to have the board adopt at the next meeting.   When this is adopted it will need to be posted and given to each Department Head.

B.   Land Sale - Supervisor Strader wanted to notify the board that the land on the river that was returned to the town can go up for sale or whatever the board would like to have done with it.   He would like to get some suggestions for the August meeting.

C.   Resolution # 10 Supporting the Creation of a County-Wide Health District - This is to be table until a later date.

D.   Housing Authority Board Member - Supervisor Strader made a motion, seconded by Councilman Winters to appoint Bruce Green to a five-year term on the Housing Authority to replace Bruce Richardson starting immediately.

                                                            Ayes - 5       Nays - 0

E.   Recreation Chairman - Supervisor Strader informed the board that Sheila Mehaffy has asked the recreation committee to appoint her for the Recreation Chairman. Councilman Schneller made a motion, seconded by Supervisor Strader to approve the appointment of Sheila Mehaffy as Recreation Chairman - for the sum of $5,000 per year.

F.   Nursery School - Town Clerk McBath informed the board that the nursery school would no longer be using the Town Hall for the classroom.   Town Clerk McBath requested permission to use for the room for storage for the Court Clerk.   The present room would be used for the Town Clerk, Assessor and Code Enforcer.   Supervisor Strader stated that the Librarian would like to have the Historian be moved out of the Library, so he is recommending that the Historian moved to that room.   Town Clerk McBath said it was not possible for the Historian and the court records to be in the same room for confidential reasons.   Supervisor Strader informed the Town Clerk that she could start moving file cabinets into the room.   If needed a wall could be put up to separate the Historian and Court Records.

G. Gasoline Quotes - Only one company responded to our request

                      MX Petroleum responded with a quote of $3.5500 plus taxes as needed.

Petroleum Traders             No Response       

Valero Energy Corp             Could not reach.

Councilman Collins made a motion, seconded by Councilman Winters to accept the bid for 2000 gallons of Gasoline for the price of $3.5500 plus taxes a needed.

                                                                                    Ayes - 5           Nays - 0

13.       Executive Session

Councilman Collins made a motion, seconded by Councilman Schneller to go into Executive Session pertaining negotiation at 6:30 PM.

Councilman Collins made a motion, seconded by Councilman Schneller to return to the regular meeting at 7:05 PM.

14. Adjournment

Councilman Collins made a motion, seconded by Councilman Winters to adjourn the meeting at 7:06 P.M.
