TOWN OF LISBON BOARD MEETING MARCH 12, 2008LISBON TOWN HALL Present: Supervisor Don Strader, Councilman C. Joseph Collins, Highway Superintendent Timothy Dow Councilman Tom Schneller, Town Clerk Donna McBath, Councilman C. Roger Shoen, Attorney Charles Nash, esq., Councilman Vincent Winters Absent: Legislator David Forsythe Guest: Greg Denny, Steve & Cindy Major, Tim Dishaw, Peter, Nathan and Ben Moelker, Matt McAllister Ogdensburg Journal, C. Bruce Green - Assessor 1. Meeting Called to Order Supervisor Don Strader called the meeting to order at 6:15 PM. 2. Minutes Approvals February 13, 2008 Councilman Schneller made a motion, seconded by Councilman Winters to approve the meeting minutes February 13, 2007. Ayes - 5 Nays - 0 3. Approval of Town Clerks Report Councilman Winters made a motion, seconded by Councilman Collins to approve the Town Clerk's Report for the month of February 2008. Ayes - 5 Nays - 0 4. Approval of Town Justice Reports Councilman Collins made a motion, seconded by Councilman Schneller to accept the Justice Reports for the month of February 2008. Ayes - 5 Nays - 0 5. Recognition of Guest Greg Denny asked if anything could be done concerning the plowing of snow on the Sportsman Club Road. The individual who plows the private Sportsman Club Road plows past his driveway to the entrance of the Sportsman Club, and deposits the snow there. When the snow is dropped in the middle of the drive and freezes, then the frozen snow can't be removed. The question was, where does the Town Board come into play? Mr. Denny requested the Code Enforcer to check into the matter, for safety reasons. It there was an emergency there would be problems. Supervisor Strader asked for advice from Attorney Nash. Attorney Nash did say that our Code Enforcer could go and check the problem for safety issues. From there, he did not know what the Code Enforcer could do. Attorney Nash informed Mr. Denny that he would write a letter to this individual, requesting that he plow the snow away from the entrance of the building. Cindy and Steve Majors - was here to observe the meeting. Tim Dishaw - was here to observe the meeting. Peter Moelker - Pastor at the Grace Presbyterian Church - presented later in the minutes. Supervisor Strader introduces Matt McAllister as our new Laison from the Ogdensburg Journal. 6. Approval of Abstracts Councilman Collins made a motion, seconded by Supervisor Winters to approve the abstracts from February 2008.
Ayes - 5 Nays - 0 7. Approval of Supervisor Report Councilman Schneller made a motion, seconded by Councilman Winters to approve the Supervisor Report. Councilman Schneller asked if the three accounts that were mentioned at the February 13 th meeting were going to be removed and put into general fund. Supervisor Strader informed him that he would notify Nicki to eliminate these amounts in these account and put them into General Accounts. Ayes - 5 Nays - 0 Highway Superintendent Report The Holding Harmless the County of St. Lawrence for Providing Service for the Town of Lisbon needs to be signed and returned to the county. RESOLUTION # 6 of 2008 HOLDING HARMLESS THE COUNTY OF ST. LAWRENCE FOR PROVIDING SERVICE FOR THE TOWN OF LISBON WHEREAS, the Town of Lisbon is desirous of St. Lawrence County Department Highways providing shared services such as paving, shoulder widening, signage, road stripping, blasting and other routine maintenance actives to the Town, and WHEREAS, both the Town of Lisbon and the County of St. Lawrence are desirous of promoting partnering efforts for the safety of the traveling public in St. Lawrence County, and WHEREAS, in this joint cooperative endeavor, the Town of Lisbon and the County of St. Lawrence desires to be reimbursed for their expenditures, and WHEREAS, the Town is aware that the County may incur liability in the providing of the services and wishes to indemnify the County in this regard, WHEREAS, the Town has indicated an interest to participate in such an effort, NOW THEREFORE, BE IT RESOVLED that the Town of Lisbon hereby agrees to defend, indemnify and hold harmless the County of St. Lawrence from and against liability, loss, damage, claim or action resulting from the work performed by St. Lawrence County Department of Highways. The Town of Lisbon does not indemnify and hold harmless the County for any liability, loss, damage, claim, or action, which arises during actual performance of services by the St. Lawrence County Department of Highways. Said St. Lawrence County Department of Highways and the County of St. Lawrence assumes the liability for losses, and claims for the actual physical performance of the work, and BE IT FURTHER RESOLVED that the following request for General Liability (GL) coverage is as follows: General Liability Insurance On an "Occurrence" basis, with the following limits: $1,000,000 Each Occurrence $2,000,000 General Aggregate $1,000,000 Aggregate $1,000,000 Personal Injury $ 50,000 Fire Damage Legal Liability $ 5,000 Medical Payment Expense BE IT FURTHER RESOLVED, that St. Lawrence County shall be an additional insured on the GL Policy, via ISO endorsement CG 2026. Councilman Shoen arrived at the meeting 7:05 PM Councilman Winters made a motion, seconded by Supervisor Strader to approve of signing Resolution # 6 Holding Harmless the County of St. Lawrence For Providing Service For the Town of Lisbon. Aye - 5 Nays - 0 Snow Removal is going to cost much more than the town had budgeted for. CW Green donated his trucks to draw sand for the highway as the town trucks were busy plowing the roads. Bridge and Port is out of salt. The town has approximately 60 to 70 tons and is using that sparingly, in the event that we received more snow and ice. Paul Fuller has been off for three and a half weeks, as he fell at home from after working long hours during the ice storm. • Dick Dawley had been off since Sunday from falling at the barns. He returned to work on March 12, 2008. One of the town pickup trucks was damaged by another town truck. The insurance adjuster has not seen Superintendent Dow concerning this. During a storm the other night at 5:00 AM, when visibility was very poor, one of our plow trucks struck a pickup that was parked on the road, instead of in his driveway. In order to attempt to avoid more damage to the pickup truck, the snowplow was veered into the ditch. Superintendent Dow informed the board that our insurance would not cover the damaged pickup as it was parked on the road and Emergency vehicles have the right a way. (Information for the public when a vehicle is parked on the road they need to notify the town barns, or Superintendent Dow or the Sheriff Department to inform the superintendent that the vehicle is there so the crew can look for it.) Road Plan has been handed out and will be discussed at the next meeting. He wanted to know that if there were any other roads that needed to be done, please inform him before the next meeting, so he can get some figures together. Superintendent Dow informed the board that if we have to many more storms there will be a phone call in for fuel as he has used 10,000 gallons. Discussion was done on overtime for the Town Highway Crew. The highway crew is interested in taking comp time instead of getting paid over time. (One-hour overtime would equal one and a half regular hours of comp time.) It would be necessary to receive union approval. Negotiation, will be starting soon between the Highway Department Crew and the town. We would need to choose two Councilmen to work on the negotiations along with two crewmen from the union Highway Department. Road Trip is schedule for Wednesday, April 9 th at 10:00 AM. Attorney Nash informed the board that when the road plan is signed, it would require a board vote for the changes. 9. Report from Legislator ForsytheWas not able to attend. Bruce Green - Lisbon Assessor Mr. Green would like to make the recommendation to stay at the 85% level of assessment for 2008 (thus not activate a 16% trend for residential properties). He also recommended doing a 2009 re-evaluation town wide. Negative to this recommendation would be slightly lower exemption amounts, and the town will not receive the $5.00 per parcel of State Aid in 2009. The board fully agreed with the recommendation of Assessor Bruce Green. Peter Moelker - Grace Presbyterian Church Rev Peter Moelker, from the Grace Presbyterian Church asked to use the front steps of the town hall on May 1 st for the 57 th Annual National Day of Prayer. (History of the National Day of Prayer is an annual observance held on the first Thursday of May, inviting people to pray for the nation. It was created in 1952 by a joint resolution of the United States Congress, and signed into law by President Harry S. Truman. The National Day of Prayer is an opportunity to remember that this country was birthed in prayer and with a reverence for the God of the Mission - is an opportunity to communicate with every individual the need for personal repentance and prayer, mobilizing the Christian community to intercede for America and its leadership in the seven centers of power: Government, Military, Media, Business, Education, Church and Family.) In case of rain they would like to use the inside of the Town Hall. Supervisor Strader informed him that it would be all right for him to use the front steps of the town hall or inside the town hall in case of rain. Rev. Moelker will set up the arrangements with Donna McBath, the Town Clerk. 12. Old Business Dog Obedience Class for owners - Con't from February 12 th meeting. Ms. Siedlecki offered the town to have a meeting to help people train their dogs. Supervisor Strader requested for only her dog be at the Town Hall. No other dogs would be allowed. Councilman Winters made a motion, seconded by Supervisor Strader to allow Dog Control Person Sue Siedlecki to have the meeting for people to train their dogs. Audit for Justice - Judge Patricia Fletcher has asked for an audit for the justice Office. Councilman Schneller made a motion, seconded by Supervisor Strader to have the Justice Office audited by Hooper and Van House. Ayes - 5 Nays - 0 13. New Business St. Lawrence Gas Company franchise renewal See Town Board Public Hearing Establish a shooting range on property owned by the St. Lawrence Valley Sportsmen's Club. This was discussed during executive session and a motion was made: Councilman Schneller made a motion, seconded by Councilman Shoen for the Lisbon Town Board to be the Lead Agency for the for the St. Lawrence Valley Sportsman Club. Ayes - 5 Nays - 0 C. Increase on Fees for Building Permit/Inspection Requests Proper paperwork was not available at this time. D. Fence Ordinance - There was a discussion on this matter and Attorney Nash will do up the Local Law after he investigates. Beach Rates - Beach Rates increase Pavilion - Increase weekday rates from $60.00 to$75.00 Increase weekend rates from $120.00 to $140.00 Eliminate non-resident rates, or charge $125.00 for residents and $150.00 for non-residents. Resident/Non-Resident Fees Raise fees from $18.00 to $20.00 for residents and $19 to $22.00 non-resident If we add concrete sites on full hook-ups, the rates should be higher. Tent sites from $16.00 to $18.00 resident, and $17.00 to $19.00 non-resident There will be no discount for seasonal campers. Councilman Schneller made a motion, seconded by Councilman Winters to approve the increase at the Lisbon Beach/Campground. Ayes - 5 Nays - 0 Resolution # 5 for Cooperation Agreement RESOLUTION # 5 RESOLUTION FOR COOPERATION AGREEMENT At the meeting of the Municipal Governing Board of the Town of Lisbon, held on the 12 day of March 12, 2008, Governing Board Member Winters offered the following: Whereas, the national Affordable Housing Act of 1990 created new initiatives to produce and preserve affordable housing including the HOME Investment Partnerships Program (HOME), and Whereas, the HOME Investment Partnerships Program will provide monies to states and local governments to fund affordable housing strategies, and Whereas, Section 216 (2) of the National Affordable Housing Act provides that a consortium of geographically contiguous units of general local government may apply for funding under the HOME Program, and Whereas, the Town of Lisbon has determined that it is desirable and in the public interest to cooperate with the County of St. Lawrence, in order to participate in the North Country HOME Consortium comprised of the County of Jefferson, County of Lewis, and the County of St. Lawrence, to receive funding under the HOME program. Now, Therefore, Be It Resolved that the Municipal Governing Board authorizes its Chief Elected Official to execute, on behalf of the Town of Lisbon, a cooperation agreement with the County of St. Lawrence to undertake or assist in undertaking housing assistance activities for the HOME Investment Partnerships Program. Councilman Winters made a motion, seconded by Supervisor Strader to approve Resolution # 5 Resolution For Cooperation Agreement. Ayes - 5 Nays - 0 Chairs for Town Hall Supervisor Strader stated that he had spoken with a woman, who wanted to know if she could buy 6 wooden chairs that are stored on the stage of the Town Hall. Supervisor Strader stated that since the building is a historical building, then the chairs should stay with the building. The board agreed with Supervisor Strader. Land & County Taxes - 2 nd notice fee Resolution # 1 - Penalty Charge for Second Notice Councilman Winters made a motion, and was seconded by Supervisor Strader, to accept the Resolution # 7 to approve a penalty of $2.00 to be charged against each tax parcel requiring a second notice. RESOLUTION # 7 - 2008 BE IT RESOLVED that the Town of Lisbon hereby approves a penalty of $2.00 to be charged against each tax parcel requiring a second notice. Aye - 5 Nay - 0 Organization for board meetings. Supervisor Strader asked Attorney Nash who was responsible for organization of the Town Board Meetings. Attorney Nash informed him that the Supervisor and Town Clerk should work together, but it was completely up to the Supervisor of what should be on the agenda. Attorney Nash also stated that since the Town Clerk took the minutes, there would be continuity from meeting to meeting. It was agreed upon that the agenda would be done by noon on the Tuesday before the Wednesday meeting. 14. Committee Reports A. Planning Board Minutes were not in the folders 15. Executive Session Councilman Collins made a motion, seconded by Councilman Schneller to go into executive session at 6:55 PM for communication of purchasing land and lawsuit. Councilman Collins made a motion, seconded by Councilman Schneller to come out of executive session at 7:30 PM. 17.
