Present:

            Supervisor Roger Watters, Councilman C. Joseph Collins, Highway Superintendent Timothy Dow, Councilman Thomas Schneller, Town Clerk Donna McBath, Councilman C. Roger Shoen, Attorney Charles Nash, esq.

1.       Meeting Called to Order

Supervisor Roger Watters called the meeting to order at 6:30 PM.

Councilman Schneller made a motion, seconded by Councilman Collins to approve the minutes for August 8, 2007.                                  Ayes - 3       Nays - 0

•  Approval of Supervisor Report

Councilman Collins made a motion, seconded by Councilman Schneller to approve the Supervisor Report.                                           Ayes - 4       Nays - 0

•  Highway Superintendent Report

•  Everything was completed regarding the original road plan.   There is a small section on the Town Line Road that was on the schedule but was not completed.   This road should be completed the week of October 1st .

•  Superintendent Dow stated that he should have a balance on all the bills for blacktopping that has been done this summer for the next meeting.  

•  Superintendent Dow requested that, if there was a remaining balance in the budget, he be allowed to complete the roads that were tentatively on the schedule.

•  The county blacktopped 6.6 miles of road.

•  The Lisbon Highway Department had blacktopped a little over a mile before the County had arrived.

•  Superintendent Dow felt that the town was coming short of our mileage that needs to be completed.

•  The County Highway Department will be arriving for paving at the end of the week of August 6, or the first part of August 13 week.

•  Cold Springs road is holding up very well considering the amount of trucks and the amount of weight that is being transported over the road.

•  Town Clerk McBath asked why the highway department did not complete the Dezell Road at the end. Superintendent Dow stated that the county would like to take the divider out of the middle of the road.   There will still be a gradual right hand turn so the traffic turning right will not go into the further lane while turning.

•  CHIP's money has been received in at the amount of $130,000.00.   $43,000.00 is yet due.   Superintendent Dow will be applying for that amount shortly.

•  Supervisor Watters stated that he had heard from Fish and Wildlife. They will be sending information concerning the beach area.   Councilman Schneller stated that there is money available through the DEC and soil and water.

      10. Old Business

•  RidgeviewTel - Supervisor Watters asked Attorney Nash if he had received the revised contract back from Ridgeview Tel.   Attorney Nash responded that he had not received any answer in any form. The board felt that it should contact RidgeviewTel to see what was going on. There was a concern about the electrical hookup. That clause will be removed from the contract, and a new revised copy will be sent back to Ridgeview Tel.

Councilman Collins made a motion, seconded by Councilman Schneller to approve Supervisor Watters to sign the contract when it is returned to him for Ridgeview Tel.                                                                                           Ayes - 4       Nays - 0

Supervisor Watters asked Russ Finley if he had the paperwork that is needed for the planning board. Mr. Finley replied that RidgeviewTel does not have it.   He stated that RidgeviewTel does not fall under the qualification of a public utility, so therefore they do not need any building permit or do any other paperwork.   Russ Finley was informed that RidgeviewTel needed to complete the paperwork for the liability issue.   The Planning board requested this paper work and Supervisor Watters stated that the Planning board was not out of line for asking for this paperwork.

•  Chair Lift for Library - The bids were opened and were as follows:

We received $35,000 plus interest from Senator Wright's office.   The remaining balance would be paid from the Library Account. The Library Board was notified of this.

Councilman Collins made a motion, seconded by Councilman Schneller to accept the bid from Morley Bay Construction.                     Ayes - 4       Nays - 0

Councilman Schneller made a motion, seconded by Councilman Collins to bring the $35,429.77 into the budget and will be debit the Library account for $6,138.23

Supervisor Watters also asked for Councilman Shoen to thank the Library Board for the good job done.                     

              C:       Review Local Court Records - Reminder.   Town Clerk McBath was informed that two councilman would be in on Tuesday to look at these records.

•  Recreation Building - Authorization for bids for materials.   Karl Bender from AOK Engineering in Ogdensburg has sent us an Invitation to Bid packages.   Supervisor Watters asked the board for authorization to put this bid out for materials for the Recreation Building.   Sealed Bids should be received by October 10, 5:00 PM.

Councilman Collins made a motion, seconded by Councilman Schneller to authorize Supervisor

Watters to put the bid out for materials for the Recreation Building.

Town Clerk McBath asked how many days and where do they want it published? She was asked to publish it in the Watertown Times and Ogdensburg Journal under Legal Notice for 2 days.   It was agreed upon October 3 and October 7.   She would also notify some contractors that the bid is coming out and asked if they would be interested in the bid. Supervisor Watters asked Superintendent Dow if the plumbing could be in place for the building and excavation work can be ready for the contractor to pour the cement. Superintendent Dow commented that the work could be completed by the 2nd week of October weather permitting.

•  New Bath House at Beach - A hard copy has been received from Burley & Gemmick for the new bathhouse.   Some things need to be changed in the design.   Supervisor Watters suggested to have the middle of the building wider so there is more room to work in.   When plumbing is being done, to stay away from the copper piping because water and chlorine destroy the copper.   It was also suggested that a system be found to treat the water or a piping that would hold up against hard water.   As soon as these corrections are received, they are to be sent to John Suloway, with a copy to Paul Finnigan to make the arrangement to transfer the funds to us.

      11. New Business        

•  Sex Offender - Councilman Shoen asked if there could be a local law on restricting a sex offender from locating near school property, the library, the playground, the beach, or any other public place where children might be in attendance. Attorney Nash said he would research this. - Many concerns from the community were also voiced regarding sex offender settling in the township, what legal steps can the board take?   The board informed the guests, there really isn't anything the town can do since the offenders are not on any kind of parole, or all being supervised by a parole officer. Anyone that has paid for his or her crime has just as much right as the public has. Supervisor Watters informed the public that there has been a press release to announce to the public that there is a St. Lawrence County Sex Offender Management Project to educate the community.   The next meeting is October 9, in Morristown.

•  Librarian Director Resignation - Sylvia Armstrong has handed in her resignation effective October 30, 2007.   Town Clerk McBath also informed the board that she is willing to stay on longer to train someone.

Councilman Collins made a motion, seconded by Councilman Schneller to approve posting the advertisement for the position.         Ayes - 4       Nays - 0

•  Boat docks at the Beach - Town Clerk McBath brought it to the attention of the Board that the boat docks needs to be removed from the water for the winter.   Councilman Collins is going to look into this matter and call vendors, requesting a fax quote back.

Supervisor Watters was asked by Mike O'Neil if the extension for the sewer and water lines are going to be put in.   Highway Superintendent Dow stated that if the weather stays like it is, they might be put in this fall, if not this spring.

•  Museum - Supervisor Watters asked if the rocks have been put in yet.   Highway

      Superintendent said no.

            Correspondence

Notice from the Board of Legislators: there will be a meeting at SUNY Canton on October 14, at 5:30PM regarding information on the Ethical Mind Field, avoiding miss steps on government service.  

Local Government Task Force - Proposal to have the County Legislature Reconsider its Support of the St. Lawrence River Redevelopment Agency Economic Development Proposal.   The Task Force has prepared a document, and is requesting the town for a resolution in support of this document.

The Task Force also requests a resolution on the shoreline study on potential business in the area that is within the boundaries.

•  Recognition of Guest

Terry Francis from SH 37 inquired about the piece of land that was coming back to the Town of Lisbon, and what was going to happen to it.   The board informed Mr. Francis that they would get back to him when a decision was made.

Russ Finley - Another discussion on the RidgeviewTel - asking why does RidgeviewTel need to complete these forms.   Supervisor Watters stated that the committees help represent the town to help the town board.   The Planning Board has asked for RidgeviewTel to complete the forms so business can move forward.   It was asked if Mr. Finley had the paper work that needed to be filled out.   He replied that he had not seen the papers.   Town Clerk McBath informed the board and Mr. Finley that she had e-mailed them to Apryl at RidgeviewTel.   Now the town board will either receive a reply from Apryl, or Supervisor Watters will contact her.

Councilman Schneller made a motion, seconded by Councilman Shoen to go into executive session for Contract Legal Issues at 8:05 PM.   Sue Sledlecki and Town Clerk McBath were asked to attend the meeting.                                                Ayes - 4           Nays - 0
