TOWN OF LISBON BOARD MEETING AUGUST 8, 2007LISBON TOWN HALL Present: Supervisor Roger Watters, Councilman C. Joseph Collins, Highway Superintendent Timothy Dow, Councilman Thomas Schneller, Town Clerk Donna McBath, Councilman Vincent Winters, Attorney Charles Nash, esq. Absent: Councilman C. Roger Shoen Guest: Larry Trombley, Russ Finley, Rodney Cross, Patty Thomas 1. Meeting Called to Order Supervisor Roger Watters called the meeting to order at 6:30 PM. Pledge Allegiance
Approval of Meeting Minutes for July 11, 2007 Councilman Schneller made a motion, seconded by Councilman Winters to approve the minutes for July 11, 2007. Ayes - 4 Nays - 0 Approval of Town Clerks Report Councilman Schneller asked if this report was just for the month of July and asked if it was correct on the total amount of 389 bags of ice that was sold. Town Clerk McBath inform him that was correct. Councilman Schneller made a motion, seconded by Councilman Winters to approve the Town Clerk's Report. Ayes - 4 Nays - 0 Approval of Transfers Councilman Schneller made a motion, and was seconded by Councilman Collins, to approve the following transfers as follows: Transfer $1800.00

Ayes - 4 Nays - 0 Approval of Abstracts Councilman Collins made a motion, seconded by Councilman Schneller to approve the abstracts from August 2007 and transfers with the exception of Invoices that were not signed. Fuller Insurance: Town Clerk McBath will check with Fuller Insurance to find out it we have received credit for the three trucks that have been removed from the policy. (If we have received the credit, the invoice will be paid) Smith Brothers invoice for chlorine: Councilman Schneller asked if it is legal to purchase chlorine from an employee his company. Attorney Nash informed the board that it is not legal to purchase from an employee of the town. It was then suggested that we contact the company ourselves to see if we can purchase it. Unemployment Insurance - The board wanted to know whom we were paying unemployment insurance on before it is paid. Christine Hammond - The board could not pay for something that hasn't been bought yet. We would need receipts and refund Ms. Hammond. Telstar Fireworks: Fireworks for the Homecoming event. This is being held, as it does not have to be paid until 30 days after the event. The voucher will be processed next month.

Approval of Supervisor Report A CD from the General Account has come due. It was reinvested for one year at 5.28 compound yield with Upstate Bank, $214,752.71. A Highway CD will be coming due in September. It will need to be placed into a money market account, as we will not be able to cash in our CHIP. The County Highway Department wasn't able to blacktop early this year. They only pay on the CHIP account quarterly. Councilman Schneller made a motion, seconded by Councilman Winters to approve the Supervisor Report. Ayes - 4 Nays - 0 Highway Superintendent Report The County Highway Department will be arriving for paving at the end of the week of August 6, or the first part of August 13 week. The Town Highway Department has completed some paving themselves. Bull Run Road has been completed. We will be able to turn in the billing to CHIP's for this road and the small section that was completed. Since we have not had the County do any paving yet we will not be able to submit any billing for CHIPS Mike O'Neil, Campground Director, has asked Highway Superintendent Dow if speed bumps could be installed at the entrance of the beach. Mr. Dow checked into how much it would cost. Blacktop speed bumps would have to be scraped off for the winter months. Rubber Speed bumps can be installed, and then removed for the winter months. They could be reused the following year. For a four-foot section, the cost would be $115.00. The board approved for Highway Superintendent Dow to purchase eight-rubber section for two speed bumps. A resident suggested that two sections be put down, instead of 4 sections, so that bicycles and motorcycles can go around the outsides for safety purposes. Dump box for the new truck has arrived. The truck will be delivered to Rt 11 during the first part of September to put the box on. Legislator's Report Legislator Forsythe did not attend the meeting. 10. Old Business A. New York Power Authority - Sparrow Hawk Point Supervisor Watters stated that he has signed the deed. It has been turned back over to the New York Power Authority for their signature. Then they will send it on to the County to get it registered, and back to us. This should be completed in approximately 10 days. RidgeviewTel - Councilman Collins asked why does one company charge for equipment and RidgeviewTel does not. Apryl informed the board that RidgeviewTel markets the rural area where DSL and Roadrunner do not reach. They work to be competitive with the other companies. Councilman Collins commented that it all depended on the different size of companies. The one that has the cash flow, as to the one that does not. Apryl commented that Russ Finley is maintaining the advocacy for RidgeviewTel in this area. He will give an update for this area. Mr. Finley stated that after visiting many area farmers he has negotiated with Peter Gendebein to place a hotspot on his silo for the Lisbon Beach. Other locations for hotspots would be on the silo at the Wallace farm and on the silo at Mr. Finley's silo. Mr. Finley also stated the more hotspots they have, the better reception for the Internet connection. April stated that they have installed this service in Ogdensburg. thus it wouldn't be difficult to get hooked up in Lisbon. Supervisor Watters asked how quickly work could proceed after the contract has been modified and signed? When the contract is signed, it should not take long for the system to be installed. Supervisor Watters asked if it could be put in the contract regarding what the town would be receiving. April said that would be all right. She also informed the board that at a later date, if the board found something else to be changed in the contract that it could happen. The contract has been given to Attorney Nash. He informed the board that they would have to go into executive session to discuss this contract. Supervisor Watters asked if it would make a difference if a hot spot is put on someone's silo regarding the tax certification from agricultural structure to a RidgeviewTel commercial structure. Supervisor Watters had checked with our Assessor who stated "no it would not change anything". (At the end of the meeting the board went into executive session to the discuss the contract. When they returned from executive session, a motion was made.) Councilman Schneller made a motion, seconded by Councilman Winters to accept RidgeviewTel to have the right to put an antenna on the town water tower pending approval of the contract. Ayes - 4 Nays - 0 C. Chair lift for Library Supervisor Watters received a call from Brooks Washburn, AIA, that the chairlift has been put out for bids for the library. The bids will be opened up on Thursday, August 16, 2007 at the Library. After the bids are opened Mr. Washburn will be looking at the bids to make sure they complete the qualifications and requirements. Supervisor Watters stated that the board would still have to meet to approve the funds for this project. Councilman Schneller asked if we knew approximately the dollar amount for this project? Town Clerk McBath stated that she called Mr. Washburn. He reported that the cost would be approximately 40 to 50 thousand dollars. Supervisor Watters stated that the amount is less than first discussed. Councilman Schneller questioned the cost for a lift compared to a $7,000 amount first inquired. Much more discussion was done concerning the amount. Town Clerk McBath asked if she needed to put the Notice to Bidders in the paper, as the architect has notified a pool of contractors for the project. The board instructed her to put a Legal Notice to the Notice to Bidders in the paper for the chair lift. Attorney Nash said the notice is already out of date. The board asked to see the plans for the chair lift. There was no chair lift available. The board asked how much we received from Senator Wright. Supervisor Watters stated that we had received $35,000. At the time of receiving it, it was put in a CD. It is now in a money market account as Supervisor Watters stated that he felt that we were ready to go ahead with his project. The board does not want to go ahead with this until they see the plans for the chair lift and meet with Brooks Washburn. Golf Cart - At the July 11, 2007 meeting the board had asked Town Clerk McBath to advertise the golf cart as is and where is. She informed the board that Todd Miller has ordered the part for the golf cart and will be repairing it soon. Therefore she did not advertise the cart. It was brought to her attention that the golf cart has been repaired and has been returned to the beach. She asked if the board still wanted to advertise the cart. They informed her that since it has been returned, do not put it up for bid. Review Local Court Records - Reminder - Supervisor Watters wanted to remind the board that it needed to review the records soon. He wanted to know if there were any volunteers to do this. Attorney Nash asked for the Town Clerk to supply monthly reports. 11. New Business Workplace Violence - Attorney Nash informed the board that there has been a new law that has come into effect as of March 4 of this year. If we have over 20 employees we would need to have a written plan regarding workplace violence. (Workplace violence is any physical assault, threatening behavior, or verbal abuse occurring in the work setting) We would need to identify all workplace Town Hall a. Town Clerk's Office b. Justice Office c. Supervisor's Office d. Assessor's office e. Building/Code Enforcer f. Nursery School Town Barn Water & Sewer facility Library Health Center Beach - Campground All Vehicles Playground Need to identify the risk of violence Not entering a building alone at night Not have substantial amount of cash in building In places where there is a risk, is there communication available Is there an area that needs more light Then arrange training session with all employees At least once a year Also for part time employees Have employees sign a document that they received training and understand what needs to be done. Types of Violence could be: a. Beating b. Stabbings c. Suicides d. Obscene Phone Calls e. Imitation f. Harassment g. Follow h. Yelled or sworn at Attorney Nash recommended that each department head draw their Workplace Violence Prevention plan and how to follow it through. It is then brought back to the Town Clerk to put it all together for the board to discuss.
Homecoming 1. Parade - All elected official are invited to walk at the beginning of the parade. Beach - Supervisor Watters asked for all board members to attend the Fireworks at the beach to assist the campground staff on parking vehicles. Trash bin from Town Barns to Beach for the weekend Town Clerk McBath asked for approval to move the trash container from the town barns to the beach for the weekend. Ron Bush will be asked to pick up the bin from the town barns and take it out to the beach for the Homecoming weekend. He will then pick it up on Monday, empty it, and return it to the town barns. We have a choice of using that bin or getting another without a cap or a truck. Another bin would mean we would have to cover it to keep the birds out. The board agreed to have the bin picked up from the town barns and moved to the beach for the weekend. Fines for Dogs 1. Attorney Nash wishes to update the dog laws. Currently dogs running at large that had gone to trail were assessed a fine of $25.00. He wishes to make the fines larger: 1 st offence $150.00 2 nd offence $300.00 3 rd offence $500.00 It would give the judge a little leeway. The board requested Attorney Nash to do a local law to bring the dog laws up to date. Town Clerk McBath informed the board that she has a list of dogs that are delinquent for license renewal. She has sent them numerous reminders to license the dogs, but has not received a notice back. Town Clerk McBath would like to send a "Notice to Appear" in court to get their dog(s) licensed. When the person attends court they will have a chance to license the dog at that time, and pay a $10.00 fine for each dog for failure to license the dog(s). If they do not attend, court then a ticket will be given to them from the dog warden to attend court, plus a fee that would pertain to the dog warden's mileage. If they come into the Town Clerk's office before the court date, they would not be charged the $10.00 fine. Councilman Schneller made a motion, seconded by Councilman Winters to allow Town Clerk McBath to mail out letters for "Notice to Appear" in court. Ayes - 4 Nays - 0 Discussion on Appointment of Assessor Supervisor Watters informed the board that he, Councilman Collins and Assessor Dan McNamara interviewed Bruce Green and Kathy Bateman for the Assessor position, which will become vacant on September 31, 2007. Supervisor Watters informed the board that Kathy Bateman has a ton of experience. Bruce Green is in the process of getting his certificate. He was just appointed assessor for DeKalb. He is also working with Jane Powers at Real Property to help him with DeKalb. Whomever the board chooses, they will have a month to work with Dan to get them prepared for Lisbon. Kathy Bateman has 35 years with the City of Ogdensburg. She has a different way of doing things, as she works from the ground up. In rural areas, the county has a way in helping the assessor.
Comments from Councilman Collins were: Bruce Green has an accounting degree from Oswego with high moral standards and is a hard worker. He had a number of recommendations, where Ms. Bateman had none to show at this point. Mr. Green is young enough to stay with a six-year appointment, and wishes to stay in the area in the future. Mr. Green is willing to get in there and get started. Ms. Bateman couldn't give a decision on when she would be able to start, if she received the position. Ms. Bateman didn't know if she could accept the $10.00 a parcel while Mr. Green said he was willing to take that offer. Ms. Bateman also informed the board that she would be working with Morristown, along with Lisbon, if she was offered the position. Supervisor Watters, Councilman Collins and Assessor McNamara recommended Bruce Green for the assessor position. Councilman Schneller made a motion, seconded by Councilman Winters to accept the appointment Bruce Green as assessor for the next six years with a starting date of September 4, 2007 with Assessor Dan McNamara. Ayes - 4 Nays - 0 4 Way Stop on Pray Rd. - Councilman Collins was asked by Councilman Shoen if a 4 way Stop can be put on the Pray Road and Five Mile Line. The request came because of the accident that happened recently that took a life. Highway Superintendent Dow and SLC Highway Superintend Dashnaw had checked into this request, as they got calls also. Highway Superintend Dow stated that it was not possible to have it changed to a 4 way stop. In order to put 4 way stop signs, both roads have to have equilivant traffic on them. The stops signs are on the Pray Road since it has less traffic than the Five Mile Line Road. If the town changed these corners into a 4 way stop there would be more accidents there than we do now. Every accident that has happened on that intersection has been proven that speed and disobeying the signs were contributing factors. With 4 way stop signs, more people would go through them because they know that the other person has to stop. The more you have a 4 way stop people rely on the other person stopping. That person will just slow down and go. The Department of Transportation advised not to change the intersection, leave as is. Town Clerk McBath asked if the advice speed limit could be changed to a speed limit. The Department of Transportation won't go with that. It has to go through a lot of channels and for the state to look at this corner. There would have to be a minimum of five accidents in a year. Streetlights on CR 28 - Councilman Winters asked who is paying for the street-lights on CR 28 and Keystone and Chapel. Highway Superintendent Dow informed Councilman Winters that it is registered on our street light bill. Supervisor Watters informed him that if he sees a streetlight out or on continuously, please notify Town Clerk McBath so she could notify National Grid. Quotes on Air Compressor - Highway Superintendent Dow informed the board that the air compressor is no longer working. He would like to purchase another 4 cylinder with 7.5 HP. The old one lasted 26 years. The cheapest compressor is $1995, which is a 2 cylinder with 7.5 HP. The one he would like to buy is a 4-cylinder cost $2360 with 7.5 HP, and with a two-year warranty. The $2360 is in stock, and is certified NYS dealer. He is very hesitant on the other for service. To repair the old one it would cost $1300. Recognition of Guest Russ Finley - Talked about going with RidgeTel. He felt that it should be a no brainier decision on what to do. Committee Reports - attached

Executive Sessions Councilman Schneller made a motion, seconded by Councilman Winters to go into executive session for Contract Negotiation and Lawsuit at 8:50 PM Ayes - 4 Nays - 0 Councilman Winters made a motion, seconded by Councilman Schneller to return to the regular meeting at 9:20 PM.
