Present:    Supervisor Roger Watters, Councilman C. Joseph Collins, Highway Superintendent Timothy Dow, Councilman Thomas Schneller, Town Clerk Donna McBath, Councilman C. Roger Shoen, Attorney Charles Nash, esq., Councilman Vincent Winters

Guest: Neil Duvall, Legislator David Forsythe, Trish McMahon

1.       Meeting Called to Order

Supervisor Roger Watters called the meeting to order at 6:32 PM.

•  Pledge Allegiance

•  Approval of Meeting Minutes for June 13, 2007.

Councilman Schneller made a motion, seconded by Councilman Winters to approve the minutes for June 13, 2007.

Approval Telephone Quotes for June 27, 2007 special meeting.

Councilman Schneller made a motion, seconded by Councilman Collins to approve special meeting minutes for June 27, 2007. Town Clerk McBath announced to the board life guards will be utilizing the existing phone instead of installing an extension from the mail office. They will retain the same number as they had in the past: 393-3832.

•  Approval of Town Clerks Report

Councilman Collins made a motion, seconded by Councilman Winters to approve the Town Clerk's Report.

•  Approval of Transfers

Councilman Schneller made a motion, and was seconded by Councilman Shoen, to approve the transfer as follows:

•  Approval of Abstracts

Councilman Schneller made a motion, seconded by Councilman Winters to approve the abstracts from June 2007 with the exception of holding the voucher for Ice Equipment.

•  Approval of Supervisor Report

Councilman Collins made a motion, seconded by Councilman Shoen to approve the Supervisor Report with the transfers.                                 Ayes - 5       Nays - 0

•  Highway Superintendent Report

•  The County Highway Department will not be arriving for black topping until the end of July or the beginning of August.

•  There are 4 ½ miles ready for the county to black top.   If the county is not able arrive soon, then the Highway Department will put in the base.

•  Asphalt has gone up by cost of $.30 this year.

•  Dump box for the new truck has not arrived yet.

•  The new truck has a crack in the cab. It will be repaired by the company.

•  The new beach truck has arrived and has been delivered.   Supervisor Watters stated that there are scratches on the back bumper. They were caused by the trailer that was being towed, as the truck did not have the proper hitch.

•  A bed liner is needed for the bed of the truck to preserve the bed from scratches.   The cost will be approximately $250.00 to $300.00

•  Legislator's Report

•  Karen St.Halaire, the county's new Administrator, will have her first day in the new job on Monday, July 16, 2007

•  Legislator Forsythe asked if we ever worked with the county on plowing, as the plowing contract will be discussed this week.   Highway Superintendent Dow informed him that the town does not work with the county on this.

•  Union Negotiations will start within the week.

      10. Old Business

                  A.   New York Power Authority - Sparrow Hawk Point

•  The town should be receiving the deed for Sparrow Hawk Point within the month

•  The Power Authority will be giving the town the guidelines stipulating the use of the money for that was received by the Power Authority from the local landowners.

•  Burley & Gemmick are checking with Klienschmidt on the new bathhouse.

                  B.   Premier Wireless Contract - Neil Duvall

Neil Duvall was present for any questions from the board on Premier Wireless.

  Councilman Schneller asked what would be the initial cost for the consumer to be connected to wireless internet.

                Mr. Duvall informed the board that the cost would be approximately $150.00

                within the village, and approximately $350.00 for customers outside the village.

                 It was asked if any other municipality was with Premier.

Premier was hooked up on the water tower in Madrid, but was not hooked up in the municipality building.

                  It was asked what would be the monthly cost to the consumer.

                   The monthly cost to the consumer would be between $17.99 to $40.00.

            The $17.99 speed for the internet would be 2 to 7 times faster than dial-up.

It was questioned what the cost to the consumer would be from Ridgetel.

            Redgetel hook up fee would be $30.00 with a monthly fee of $29.99.

                                    Premier Wireless Contract

It was asked what would the consumer be receiving for the $150.00 to $300.00 cost of hooking up.  

Premier would be hook Motorola equipment .

Mr. Duvall also stated that the beach office would get internet service for free. Service would be available to campers, with a fee. To reach the beach and campers a Hot Spot would need to be installed.

He also stated that Premier is working mainly for people that are unable to receive Time Warner (Road Runner) or DSL, which are people outside of the village.

Mr. Duvall asked when we would be making our decision for the wireless internet.   Supervisor Watters stated it would be expected to be made at our August meeting.

                  D.                   Construction on building at playground.

Volunteer would be responsible for the labor, so labor would not have to go for bid.   All materials that are needed for the project will have to go out for bid.   Also needed is a clerk of the works to supervise the job. With the Education Law all we would need are stamped plans.

The meeting was put on hold for the Local Law Meeting at 7:30 PM.

The meeting was resumed at 7:38 PM

      11. Local Law # 1 - Amendment to Regulating Junkyards

Councilman Collins made a motion under the recommendation from Attorney Nash, and was seconded by Councilman Shoen, to approve Local Law # 1 on the Amendment of Regulating Junkyards.

                  A verbal vote was taken.

      12. New Business

•  Planning Board Member Resignation

Councilman Winters made a motion, and was seconded by Councilman Shoen, to accept the resignation from Ira Morgan from the Planning Board.

•  Planning Board New Member

It was suggested that David Smith fill the remaining term that has become vacant by Ira Morgan.   Mr. Morgan term is from January 2007 to December 2010.

Councilman Shoen made a motion, and was seconded by Councilman Schneller, to accept the appointment of David Smith to fill the position of the remaining term that was vacated by Ira Morgan from the Planning Board.

•  Review Local Court Records - Supervisor Watters asked for volunteers to audit Justice Court records.

River's Septic Service Inc. - A letters was received from River's Septic Service concerning the pricing for dewatering and disposal service.   If this service was done twice a year the price would be maintained at $.125/gallon.   If it were only done once a year then the price would need to increase.   Councilman Schneller asked if we should put the job up for bid since the cost is so high.   Highway Superintendent Dow informed the board that River's Septic is the only company in the area that does this kind of work.   It was decided that when the tanks need to be drained again, it would go out for bid.

•  $2.00 fee for the Legislator Picnic - Town Clerk McBath informed the board that County Treasure Robert McNeil asked if the $2.00 fee for the Legislators Picnic be exempt.   There would be approximately 150 people there. It was decided that exemptions could not be made for one and not for others.

•  Golf Cart - It was inquired, if the town would be interested in selling the golf cart that was at the beach at one time.   The board informed the Town Clerk that a legal ad would need to be published for the golf cart.   When published it would state that the buyer would be purchasing as is and where it is (located at Todd Miller's).   A legal ad will be going into the paper for this sale for next month decision.

Councilman Shoen made a motion, and was seconded by Councilman Schneller, to go into executive session at 8:05 PM on Legal Matter.
