TOWN OF LISBON BOARD MEETING OCTOBER 11, 2006LISBON TOWN HALL Present: Supervisor Roger Watters, Councilman C. Roger Shoen, Town Clerk Donna McBath, Councilman Thomas Schneller, Highway Superintendent Timothy Dow, Councilman C. Joseph Collins, Attorney Charles Nash, esq. Guest: County Legislator Stephen Teele, Jesse Donaldson - Lisbon , Stephen Wallace - Lisbon, Larry Trombley - Lisbon, Steve Jemison - Lisbon AMP Represented, Trish McMahon - Ogdensburg Journal 1. Meeting Called to Order Supervisor Roger Watters called the meeting to order at 6:32 PM. Pledge Allegiance Approval of Meeting Minutes for September 28 2006. Councilman Schneller made a motion, and was seconded by Councilman Shoen to approve the minutes for September 28, 2006. Ayes - 4 Nays - 0 Addition added to the minutes at the bottom of the page Approval of Town Clerks Report Councilman Shoen made a motion, and was seconded by Councilman Collins, to approve the Town Clerk's Report for September 2006. Ayes - 4 Nays - 0 Corrections at bottom of page Approval of Transfers Councilman Shoen made a motion, which was seconded by Councilman Collins, to the transfers as follows: General To transfer $1300.00 to 7110.1 from 7110.2 To transfer $5002.53 to 7110.4 from 7110.2 Highway To transfer $216.05 to 5120.4 from 5140.4 Councilman Schneller questioned the electrical account at the beach and asked why was it so high. Supervisor Watters stated that there were some very large RV's at the park this year. Ayes - 4 Nays - 0 Approval of Abstracts Councilman Schneller questioned why we had received a bill from the Lisbon Central School Band for marching at Homecoming. He had thought they had been paid at the time of Homecoming. Town Clerk McBath said she would check into it. He also wanted to know how we were going to pay for a 2005 voucher. He asked if we were sure that Josephine Skiff hadn't been paid in 2005. Town Clerk McBath informed him that she was sure that Mrs. Skiff hadn't been paid, as she and Nicole Dority, the Supervisor Secretary, had looked into it. Attorney Nash said we could still pay for this invoice out of 2006 account, even though it is a 2005 bill. Councilman Schneller made a motion, and was seconded by Councilman Collins, to approve the abstracts for September 2006 with the exception of the invoice for the Lisbon Central School Band invoice to be held until verification. Highway Superintendent Dow informed the board that there may be a forthcoming fine from the DEC because when the old fuel tank was removed, the DEC was to be notified thirty days previous to closing that area.
Ayes - 4 Nays - 0 Approval of Supervisor Report Supervisor Watters informed the board that there was a problem with the Supervisor Report and wished to have a chance to get all corrected. Highway Superintendent Report Approximately all the sand has been brought in for the road during for the winter months. The highway department is waiting for Doug Smith, Water and Sewer Supervisor to get the piping for the sewer line to connect Edward Knight's residence lot that is beside the Health Center. The highway department is planning to work on the area at the beach for drainage before the frost sets in this fall. Legislator's Report Legislator Stephen Teele gave a verbal report. The County budget was presented at the local County meeting. Legislator Teele informed Supervisor Watters to use the same figure for sales tax revenue as last year since the County Budget hasn't been completely finished. Ogdensburg Land Fill has been turned over to the County. The County tests for contamination on a regular basis. If there is any contamination material leaking out, it is collected by the County and disposed of. For Information - Camp Laurent - Paper work has been signed with the Power Authority for land that is being returned to them. AMP - Steve Jemison - AMP Representative for the Lisbon Town Board informed the board that the feasibility study is still on going. There are now 21 communities and towns that have joined AMP. They have approximately $26,000.00 in their treasury. 7:00 PM Regular Meeting was temporary adjourned for a Public Hearing on Local Law # 2 - Providing for the Administration and Enforcement of the New York State Uniform Fire Prevention and Building Code. Supervisor Watters informed the board members and audience on what is in the Local Law # 2. Attorney Nash recommended the law as all the towns were passing the same law. Public Meeting was closed at 7:06 PM. Return to regular Meeting at 7:06 PM Old Business NYPA & DEC Bank Swallow Issues - The Putney Family, Joe Babbitt, Supervisor Watters, along with NYPA personnel and DEC personnel met at the Putney Farm to discuss the land along the Putney Farm on October 4, 2006. No issues were settled. Corrections on this item at the bottom of the page. 12. New Business A. Local Law # 2 - Providing for the Administration and Enforcement of the New York State Uniform Fire Prevention and Building Code. Councilman Collins made a motion under the recommendation from Attorney Nash, and was seconded by Councilman Shoen, to approve Local Law # 2 Providing for the Administration and Enforcement of the New York State Uniform Fire Prevention and Building Code. Ayes - 4 Nays - 0 Relevies of Water & Sewer Acct. Councilman Shoen made a motion, and was seconded by Councilman Schneller, to transfer all Water and Sewer Relevies to the County to be placed on the 2007 County and Land Taxes. Ayes - 4 Nays - 0 Amp Resolution #13 Pierrepont RESOLUTION # 13 of 2006 AMP MEMBERSHIP FOR THE TOWN OF PIERREPONTWHEREAS, the Town of Pierrepont has a strong interest in the Alliance of Municipal Power (AMP) and has voted unanimously to join AMP, and WHEREAS , the addition of the Town of Pierrepont would strengthen the pursuit of municipal power, and WHEREAS , the Commissioners of AMP have unanimously voted to recommend the membership of the Town of Pierrepont, be it resolved that the Town of Lisbon votes to grant the Town of Pierrepont full membership in AMP. I certify that this resolution was passed with 4 yes votes, 0 no votes and no abstentions at a duly convened meeting of the Town of Lisbon on September 28, 2006. Councilman Schneller made a motion, and was seconded by Councilman Shoen to accept Resolution # 13 of 2006 - AMP Membership for the Town of Pierrepont. Ayes - 4 Nays - 0 D. Amp Resolution #14 Colton RESOLUTION # 14 of 2006 AMP MEMBERSHIP FOR THE TOWN OF COLTONWHEREAS , the Town of Colton has a strong interest in the Alliance of Municipal Power (AMP) and has voted unanimously to join AMP, and WHEREAS , the addition of the Town of Colton would strengthen the pursuit of municipal power, and WHEREAS , the Commissioners of AMP have unanimously voted to recommend the membership of the Town of Colton, be it resolved that the Town of Lisbon votes to grant the Town of Colton full membership in AMP. I certify that this resolution was passed with 4 yes votes, 0 no votes and NO abstentions at a duly convened meeting of the Town of Lisbon on September 28, 2006. Councilman Schneller made a motion, and was seconded by Councilman Shoen to accept Resolution # 13 of 2006 - AMP Membership for the Town of Colton. Ayes - 4 Nays - 0 E. North Country Life Flight Resolution #15 RESOLUTION # 16 of 2006 LAND TO JESSIE DONALDSON WHEREAS , North Country LIFE FLIGHT, Inc. is a not-for-profit, tax-exempt corporation which is responsible for all aspects of patient care by providing medical equipment, training medical personnel and administering the medical portion utilizing the New York State Police helicopter based in Saranac Lake and private fixed-wing aviation resources; and WHEREAS , The New York State Police and private fixed-wing aviation resources do not provide a medically trained team or medical equipment for patient transports; and WHEREAS , The people of Clinton, Essex, Franklin, Hamilton and St. Lawrence Counties receive a vital emergency medical service which is free of charge to critically ill and seriously injured patient, and, therefore municipal governments are asked to pledge monies for this worthwhile program; NOW, THEREFORE, BE IT RESOLVED: That the Town Board of the Town of Lisbon hereby authorizes the Supervisor to enter into a contract with North Country LIFE FLIGHT, Inc. for the purpose of operating the medical component of the medevac program, which will serve its residents and visitors, and paying the amount of $100.00 which represents the Town's share of 2007; and be it FURTHER RESOLVED: The sum of $100.00 is herby appropriated to Account No. 4010.4 for payment to North Country LIFE FLIGHT, Inc. Councilman Collins made a motion, and was seconded by Councilman Schneller for Resolution # 13 of 2006 to pay Life Flight $100.00. Ayes - 4 Nays - 0 F. Land to Jessie Donaldson Resolution # 16 RESOLUTION # 16 of 2006 LAND TO JESSIE DONALDSON WHEREAS , Jesse Donaldson owns a piece of land in the Town of Lisbon, designated at Tax Map No. 61.002-1-24, being approximately 3.5 acres and located off the Swamp Road; and WHEREAS , the Town of Lisbon owns land surrounding said Donaldson's land and designated as Tax Map WHEREAS , said dirt path or road also could be used to enter said Jesse Donaldson's property; No. 61.002-1-26.1; and WHEREAS , said Jesse Donaldson has made an offer to the T own of Lisbon to Purchase a right-of-way across this dirt path approximately twenty feet (20') in width along the dirt path as it presently exists for ingress and egress only to his property designated as Tax Map No. 61.002-1-24 for the price of One Hundred & 00/100 Dollars ($100.00); NOW , it is, upon motion of Councilman Schneller and seconded by Councilman Shoen, RESOLVED to sell the above right-of-way for the sum of One Hundred & 00/100 Dollars ($100.00) to said Jesse Donaldson subject to permissive referendum. A roll call vote was held as follows: Con't New Business - Resolution # 16Aye Nay Roger Watters, Supervisor X C. Roger Shoen, Councilmember X Joseph Collins, Councilmember X Thomas Schneller, Councilmember X Approval accepting $25,000.00 from Senator Wright Office Councilman Collins made a motion, and was seconded by Councilman Schneller, to authorize Supervisor Watters to sign the contract for 2006-2007 Legislative Initiative Fund Disbursement Form for a portion of $25,000.00 to be disbursed to DANC for the Town of Lisbon, Town of Oswegatchie, and Village of Heuvelton. Ayes - 4 Nays - 0 Proposed New Budget - A work session will be held at the Lisbon Town Hall at 3:00 PM on October 12, 2006. Trish McMahon - Ogdensburg Journal, will put a notice in the paper for tomorrow. It will also be posted on the bulletin Board by Town Clerk's office. Recognition of Guest Larry Trombley - commented he just wanted to attend the meeting. Steve Jemison - Wanted to know who purchased the permits for the driveway on the Bowdish land. He was informed that Mr. Bowdish had purchased the permits. Trish McMahon - Ogdensburg Journal verified a couple of questions. Committee Reports A. Code Enforcement Report Planning Board Minutes 14. Executive Session Councilman Collins made a motion, and was seconded by Councilman Shoen to go into executive session for personnel discussion at 7:45 PM. Steve Wallace was asked to attend. Ayes - 4 Nays - 0 Councilman Shoen made a motion, and was seconded by councilman Collins to return to the regular meeting at 9:00 PM. Ayes - 4 Nays - 0 15. Adjournment Councilman Collins made a motion, and was seconded by Councilman Schneller to adjourn the meeting at 9:00 PM. Ayes - 4 Nays - 0 Respectfully Submitted, Donna D. McBath Town Clerk Correction in Item 11 Old BusinessCouncilman Collins asked for a letter to be sent to the NYPA for a schedule of when the money was going to be returned to the Town of Lisbon of the land that has been purchased from the landowners that they are purchasing from the Power Authority. On the advise of Attorney Nash the Town Supervisor's Report could be approved based on Supervisor Watters and Nicki Dority, Supervisor Secretary, will be working with the State Comptroller Office to correct an $1795.00 error. Councilman Schneller made a motion, and was seconded by Councilman Collins, to approve the Supervisor Report for August 2006 with the stipulation that the balance sheet be corrected.
