TOWN OF LISBON Present: Supervisor Roger Watters, Councilman Michael Duprey, Town Clerk Donna McBath, Councilman Thomas Schneller, Highway Superintendent Timothy Dow, Councilman C. Joseph Collins, C. Meeting Called to Order Supervisor Roger Watters called the meeting to order at 6:30 PM. Approval of Minutes for February 8, 2006 Corrections in spelling on page 4 - Tom Grove to be Tom Grow - and on page 5 delete Duprey on a motion. Councilman Duprey made a motion, and was seconded by Councilman Collins, to approve the minutes for February 8, 2006 with the corrections Ayes - 5 Nays - 0 Old Business A. Shut off valve for the museum - Supervisor Watters has notified the Bridge and Port Authority on the missing water valve for the museum. They had informed him to contact the railroad and find out who was the subcontractor that did the work. Supervisor Watters was going to contact the subcontractor and find out which party they were going to do the work on locating and repairing the valve, or were we to do the work and charge them. Councilman Duprey informed the board that Water Maintenance Man Doug Smith stated it was plastic piping from the main line to the museum. Doug reported that he could locate the piping, dig it up, crimp the pipe, put a valve in, and close it up. The board agreed this would be much better and faster. The work would start in the spring. Spec for fence for around water tower - Supervisor Watters informed the board that the insurance company had no specifications or regulations for the fence. The fence needs to be installed for Home Safety. Highway Superintendent Dow will measure around the tower and try to draw some specification to be bid on. Surveying on Medical Center Land - Received a price for surveying this land from WCT Surveyors, P.C. (Wilhelm, Chatelle & Towne, Surveyors) at the cost of $650.00. Councilman Duprey stated that it would be a mistake to sell the land, as the town may need it at a later day for a new office building, a new health center, or new barns. It was agreed by the board to have the land surveyed just to see what was there. Councilman Shoen made a motion, and was seconded by Councilman Duprey, to have the land survey for $650.00 by WCT Surveyors. Ayes - 5 Nays - 0 New Business A. Tisdel Associates - Ron Berry spoke on designing the sidewalks for the village of Lisbon. - Sidewalk from the Park to the Post Office is approximately ½ mile. - Place sidewalk on the uphill side (left side coming from park) to mid-village and change over to right side to Post Office. Recommended to install in sections. Buried utilities (etc. gas line, cable, and telephone lines, should not be problem. Utility poles and trees should be no problems. (work around them) Recommend not moving utility poles and curving around trees if needed. It was suggested that the project be done in phases, as the budget would allows due to the cost of the project. The cost for 4' wide x 3' lengths x 4" thick - is more around $36.00 per section according to Mr. Berry. Mr. Berry wanted to know what we were really looking for in this work. Were we looking to do this in house or contracted out? He also wanted to know what we felt would be our finishing price. The board noted that we needed to know the cost before we could commit. The board asked for Tisdel Associates to draw something up for prices with drawing and bring it back for our March 8 meeting. New York Power Authority - Appraisal Councilman Collins informed the audience that there was a meeting on February 3, 2006 concerning issues of 28 & 29A The board wanted Issue 28 Lands to proceed with the transfer of Map No. #1184C Parcel No. # 8629. He also stated that the boundary line was incorrectly identified on the map regarding map no. 1125C Parcel No. 8093 known as Sparrow Hawk Point. He felt that it must be addressed prior to the transfer of this parcel. Councilman Collins stated that Issue 29A - with the following parcels: Map No. # 193C, Parcel 8628, Map No. # 1183C Parcel 8627, Map No. # 1184C Parcel 670, Map No. # 1185C Parcel 8097, Map No. # 1185C Parcel 8697 and Map No. # 185C Parcel 8103 should proceed with the surveys and appraisals. It is the town position to have NYPA deal directly with the adjoining landowners in these areas, as there are many encroachments and improvements by others in these areas. Councilman Collins said the appraisal books are in for people to look at that have property between them and the river. One book list of property that is less than an acre and the other is property for more than an acre. Guy Mills commented that he and the other people that were there would like to get the land back into the names of the appropriated landowner. The board informed the audience that a letter will be sent to the landowners inquiring if they are interested in purchasing the land as stated in the appraisal. If they were interested then they would need to sign the letter and return it back to the Power Authority with a 10% down payment. After the Power Authority received the letter with the 10% down payment, a contract would be sent to the people. They are then to return this signed contract with the remaining 90%. The Power Authority would then send to them a deed after registering the land purchase at the county. Rhonda Roethel wanted to know why they were going to receive a quick claim deed and not a warranty claim deed? Councilman Schneller showed her a paragraph from the appraisal books on her question. Marty Ryan would like to have the board inform the Power Authority that the people were very interested in the proposal with a resolution. Councilman Schneller made a motion and was seconded by Councilman Duprey to have the board write a resolution to inform the Power Authority that the people were very interested in the land and wanted to move on this proposal. RESOLUTION # 4 of 2006 NEW YORK POWER AUTHORITY RELICENSING WHEREAS, the Town of Lisbon has been involved in the relicensing process for the New York Power Authority's new Federal License for the St. Lawrence - FDR Power Project; and WHEREAS, as part of the license agreement, land within the project was designated to be returned to private ownership and removed from the project boundaries; and WHEREAS, staff from the New York Power Authority were proceeding with the transfer when the New York State Attorney General's office noted that this could not occur as was agreed to in the Federal License; and WHEREAS, the Attorney General's staff met with representations of the Town of Lisbon and New York Power Authority and agreed that if the land was appraised and the landowners purchased the land at the appraised valve, they would agree to the transfers; and WHEREAS, the New York Power Authority agreed to have each parcel appraised; and WHEREAS, these appraisals have been completed and made available for effected residents to review; and WHEREAS, having reviewed the various appraisals, the residents have asked the town board members convey to the New York Power Authority their wish to have this land transfer completed; and THEREFORE, the Town Board of Lisbon request the transfers be completed as soon as possible to allow residents to purchase the land in question. Regarding Map No. 1125C Parcel No. 8093 known as Sparrow Hawk Point, we feel that the boundary line was incorrectly identified on the map and must be addressed prior to the transfer. Rhonda Roethel wanted to thank everyone including Marty Ryan for his time and help in this matter. Marty Ryan also wanted to thank the previous and present board and anyone else that helped in this matter. C. Premier Wireless John Morgan from Premier Wireless - Morley, New York asked the board if they would consider putting an antenna on top of the water tower in Lisbon. He showed the board what would be installed at the top of the water tower and explained to them how it would work. He also informed the board that he had quite a few people from the Murphy Road that are interested in the wireless internet. Mr. Morgan informed the board that his prices are compatible to Road Runner and DSL. He informed the board that he had installed this in Canton and felt they were very happy with it. If the board was interested he would do the same as he had with the other municipalities. That would be that the town offices would get it free or he would pay rent for use of the water tower. The board asked Mr. Morgan to get figures together and returned it back to the board so that they could look at it. Alternate Power Sources - Literature was given to the board at the previous meeting and hope they had looked at it. We will discuss it more at our second meeting in March. Ayes - 5 Nays - 0 Recreation Trail - Supervisor Watters informed the board that the recreation committee is developing a committee to further research grant opportunities for a walking trail to encompass United Helpers ICF -United Helpers Castle Ridge Manor and Lisbon Central School. USDA office and Parks and Recreation will be contacted for possible grant opportunities. Other Discussion - Councilman Duprey has brought to the attention of the board that our dump trucks are aging, and we need to look into purchasing a new one. Highway Superintendent Dow informed the board that if we purchase later we would get a 2007 truck. With this it would cost $15,000.00 more because of the emission in the vehicle. He said if we were interested we should order by the first of May and receive a 2006. After that we would receive a 2007 truck. He also requested looking into ordering two trucks, one complete truck with plow and one with cab and chassis, which he has a box to go onto it. The board asked for him to bring prices for leasing and purchasing. Also, he should check to see if there were any rebates for a vehicle for the next meeting. Supervisor Watters would check on how bonding works, since by state law, the cost of the vehicles would mandate bounding since we can not spend more than $60,000.00 per year for new equipment.
