1. Meeting Called to Order
Supervisor Anthony LeBarge called the meeting to order at 6:30 PM

Approval of Minutes
On a motion from Councilman Duprey and seconded by Councilman O’Brian to approve the September 22, 2005 minutes. Ayes – 4 Nays – 0
Councilman Watters had not arrived yet.

Approval of Town Clerk’s Report
On a motion from Councilman Duprey and seconded by Councilman O’Brian to approve the Town Clerk’s Report for September 2005. Ayes – 4 Nays – 0
Councilman Watters had not arrived yet.

Approval of Supervisors Report
On a motion from Councilman Duprey and seconded by Councilman O’Brian to approve the Supervisors Report. The last quarter Sales Tax has not been received as of yet. Should be receiving in the near future the Star program check, Mortgage tax, and the United Helpers check Ayes – 4, Nays – 0
Councilman Watters had not arrived yet.

Highway Superintendent Report
The Flack Road will be not be able to be paved this year as the County Highway Department is booked until the 2nd week of November. The Dezell Road has been started along with brush being trim on other roads. A culvert has been changed on the Swamp Road so the water will drain and the Hall Road won’t be flooded this spring.
The Heuvelton Road has been patched. Councilman Jemison asked way was their patching done when the road was going to be ground up. Highway Superintendent Dow informed the board that there needed to be patched work done so there would be something to grind up. Supervisor LeBarge once again stated that he thought the road was going to be ground up and the decision was going to be made this week as to hardtop or leave the road to settle before hard topping next year. Highway Superintendent Dow informs the board that it would cost $10 to $12 thousand dollars to hardtop 1.2 miles of the Heuvelton Road. Supervisor LeBarge asked, “was it too late to grind the road from County Route 28 to railroad tracks?” Councilman Jemison stated that he felt the Heuvelton Road was more important than cleaning out the Swamp Road. Highway Superintend Dow stated that it was just maintenance work that was being done on the Swamp Road. Supervisor LeBarge stated if we have time to grind up the Heuvelton Road as we have the money to do it.
Highway Superintendent Dow stated that if the Lisbon Highway Department hardtops the Flack Road, we couldn’t do as good of a job as the County could do.
Highway Superintendent Dow informed the board that the wires were taken down on the Hardscrabble Road at the Wallace Residence. There will be bills coming in from Ogdensburg Electric and Mike Spearance. The total of repairs should not total more than $500.00. It was not turned into the insurance company, as he felt there was a $1,000 deductible. Supervisor LeBarge informed Highway Superintendent Dow that the incident should have been turned into the insurance company.
Ventilation System is in, but waiting for the electrician, Doug Smith, to install new circuit breakers to hook up the system.

Approval of Transfers –
On a motion from Councilman Watters and seconded by Councilman Jemison to approve the transfers as follows:
General Fund
To transfer $6,000.00 to 6989.4 from 1620.2
To transfer $1,500.00 to 7110.4 from 7110.2
To transfer $2,500.00 to 680.4 from 1620.2
Water Fund
To transfer $500.00 to 8320.4 from 8320.2
Sewer Fund
To transfer $1,800.00 to 8130.4 from 8120.4

Approval of Abstracts
On a motion from Councilman Watters and seconded by Councilman Duprey to approve the abstracts.
Discussion was done: Councilman Duprey felt the labor charge of $30.00 for 2 hours from Councilman Jemison to attend a meeting at Attorney Nash’s office should not be paid. Councilman O’Brian stated that he should be paid, as he receives no personal time where he works. Attorney Nash stated to the board that Councilman Jemison needed to be at this meeting as he was involved with negations with the union and it was much easier to do the meeting in his office and not at the board meetings.

Heather Swanton from the Ogdensburg Journal.
Malcolm Middlemiss – On the 2006 Budget revenue from Homecoming would be $2500.00.
He also stated that he needed ideas for next year Homecoming. Supervisor LeBarge informed Mr. Middlemiss that we would be discussing budget next meeting.
Mark Ginn asked if the Lisbon board had come to a decision on if they were interested in selling the lot next to Lisbon Medical Clinic. Attorney Nash informed the board that the lot needs to be surveyed, and then Mr. Ginn can make an offer. Then it would be subject to referendum. Mr. Ginn then asked if the board is interested in selling to take the matter any further. Councilman Duprey informed him that he was not in favor of selling the lot, as it was a valuable piece of land for the town. Councilman Jemison and Councilman O’Brian said that they would like to explore the idea. Mr. Ginn was informed that the lot would be surveyed and then he would be contacted.
Mark Ginn asked if the board could have a street light put up at the end of Sparrow Hawk Point Road as it was very hard to locate after dark.
On a motion from Councilman Jemison and seconded by Councilman Watters to check with Niagara Mohawk to see what the cost is and what needs to be done to have a light installed.

Steve Wallace commended that the shooting range was much better this year. Also, wanted to let the board that he thought a fence would be installed around the complete shooting range. There was only a fence installed across the front of the shooting range.

Executive Session
On a motion from Councilman Watters and seconded by Councilman Duprey to go into executive session for negation and litigation at 7:15 PM

On a motion from Councilman Duprey and seconded by Councilman Jemison to return to the regular meeting at 8:00 PM. Ayes – 5 Nays – 0

New Business
Supervisor LeBarge informed the board that Superintendent Ernie Witkowski of the Lisbon Central School stated the school is interested in doing shared services on the lawn mowing for the forthcoming year. Superintendent Witkowski said the mowing contract for this year will expired November 15, 2005 and he is interested in discussing with the town this shared service.

A. NYPA – Supervisor LeBarge informed the board and audience that the land has not been released to come back to the local property landowners with NYPA. Because of that, the boards from the Town of Lisbon and Lisbon Central School have agreed to work on a letter to be sent to NYPA to request compensation for lost taxes we would have received had the land been transferred as was negotiated.
A motion by Councilman Duprey and seconded by Councilman Watters to have Attorney Nash draft a letter to NYPA.
When the draft letter is completed it should be forwarded to Mr. Witkowski, Lisbon Central School Superintendent and the Supervisor LeBarge for approval. Councilman Watters stated the letter is in response to lost tax and beach revenue. Clinton W. Green stated that he feels that we should have accepted the NYPA money and stayed within the project. He wanted to know who was responsible for being taken out of the project boundaries. Mr. Green was informed by Councilman Watters that it was a Town Board decision after reviewing the potential revenue the town would receive from the land that would be placed back on the tax rolls compared to what we would have received as being part of the NYPA settlement. We would have received $59,200 each year for fifty years without any form of increase during the life of the license compared to the development potential of returning the shore line to the tax roll which many feel would exceed $10,000,000.00 added assessment. At the current tax rate, this would add more than $250,000.00 per year taxes for the taxpayers of the Town of Lisbon. Mr. Green noted that he did not agree with the board actions.

Transfer to Highway
Supervisor LeBarge requested a transfer from General to Highway 5112.4 of $80,000.
On a motion by Councilman Watters and seconded by Councilman O’Brian to transfer $80,000 from General to Highway 5112.4. Ayes – 5 Nays – 0
Relevies Water and Sewer –
On a motion by Councilman Jemison and seconded by Councilman Duprey to transfer all Water and Sewer Relevies to the County to be placed on the 2006 County and Land Taxes

Discussions
Information from Councilman Watters – On October 20 there will be a meeting on Alternative Energy at the Community Building in Madrid, New York.

Councilman Jemison informed the board that there was a shooting range being set up at the St. Lawrence Valley Sportsman’s Club. Discussion was done and it was looked into that there was not to be a shooting range set up there.

Steve Wallace asked to go into executive session for reasoning of the shooting range St. Lawrence Valley Sportsman’s Club but that was already discussed. He also wanted to know if the Town of Lisbon was going to do the repairs at his house or was he supposed to do it and send the bill to the Town of Lisbon. The board members then asked him what was damaged. Mr. Wallace stated that there was some siding torn off, and he has found that his water softener is not working properly. The ground wire on the pole is loose and the telephone is not working properly, but he would notify the telephone company on that. He stated that the telephone had been not working properly for 5 days.
It was asked to Highway Superintend Dow if anyone on the board had been notified. His comment was no. All he wanted to do was to get temporary power to the house until it could get repaired.
Supervisor LeBarge commented how could something get repaired if he was not notified and that the insurance company should have been notified.

Supervisor LeBarge informed the board that Jessie Donaldson does not have the license agreement of a right a way to get back to his property. Attorney Nash informed the board that Mr. Donaldson has no right to be on our land to get to his. Councilman Duprey suggested, that the original document be brought back and offered to Mr. Donaldson again. Councilman Jemison, O’Brian and Watters all agreed with Councilman Duprey.
