1. Meeting Called to Order
Supervisor Anthony LeBarge called the meeting to order at 6:30 PM

Approval of Minutes
On a motion from Councilman Watters and seconded by Councilman Jemison to approve the
June 23, 2005 minutes. Ayes – 5
Nays – 0

Approval of Town Clerk’s Report
On a motion from Councilman Jemison and seconded by Councilman Duprey to approve the Town Clerk’s Report for June 2005. Ayes – 5
Nays – 0

Approval of Supervisors Report
On a motion from Councilman Watters and seconded by Councilman Duprey to approve the Supervisors Report.
Councilman Jemison inquired if the computers were all up and working correctly now. Town Clerk McBath informed him that the computers are working all right, but didn’t know if there was a virus protection on her computer.

Highway Superintendents Report
Superintendent Dow informed the board that on the Barrett Paving invoices there was no freight charge. He brought it to the attention of Barrett Paving and they will be billing the charges separately. The freight charges will be approximately $23,000.
The town crew is now working on grading the sides of the roads.
Superintendent Dow has received quotes for sealant. Supervisor LeBarge suggested that we purchase the oil as soon as possible as prices for oil are going to increase by August 1st.
It was asked to Superintendent Dow why there were no freight charges on the Hanson invoice. He informed the board that the town crew drew some of the stone and the asphalt’s price included freight price as part the unit price.
Councilman Watters wanted to know what the status was on diesel fuel budget, and if we were going to be all right for the remaining of the year. Superintendent Dow informed him no, we were going to be over the budget as the price of fuel has gone up so much.
Supervisor LeBarge asked if the culvert had been order for the Dezell Road. Superintendent Dow said no as he was still waiting for County to contact him. Supervisor LeBarge informed Superintendent Dow to contact Superintendent Dashnaw.
Superintendent Dow informed the board that he would like to reconstruct the remaining half of the Keystone Road. He had looked into prices for Cold or Hot Mix. Since oil prices has increase Hot Mix is close to the price of Cold Mix.
The exhaust fan has arrived for the town barn. There is a need for more parts for the wiring to complete the installation of the exhaust fan.
Superintendent Dow informed the board that there was an accident with the large loader. While traveling down the Hardscrabble a casting line blew on the loader. When it blew the loader dropped into the highway, which brought the tractor to a halt. (If it hadn’t been for the driver wearing his seatbelt he would have gone off the tractor.) It is unknown why the line blew. The cost of replacing the casting (new) would be $3800.00. He is trying to locate a used casting for approximately half the price.
Councilman Watters asked for Superintendent Dow to have quotes for oil so the board can make a decision at the next meeting for sealing roads.
Superintendent Dow informed the board that the town has all the stone that is needed for sealing the Hanlon and Norway Road.
On a motion from Councilman Watters and seconded by Councilman Jemison to approve the Superintendent Dow and Supervisor LeBarge work together in ordering the sealant for the roads, price not to exceed over $15,500.00 for the Hanlon and Norway Roads.

Approval of Transfers –
On a motion from Councilman Jemison and seconded by Councilman O’Brian
To transfer $500.00 from 1990.4 to 3510.4

Approval of Abstracts
On a motion from Councilman Watters and seconded by Councilman Duprey to approve the abstracts.

*Councilman Jemison inquired why we purchased mixed crusher in with fine crusher. Superintendent Dow said it was for the shoulders of roads.
Councilman Jemison inquired why we purchased a weed eater for the highway department. Superintendent Dow said they use it to trim around guardrails.
It was asked of Superintendent Dow, “what did we purchase from Seaway Timber?” The board was informed that it was a hydraulic hose as they are the only company that makes up that particular hydraulic hose.
Councilman Duprey asked; was it a new procedure that we sprayed for spiders at the beach? He was informed no that we do it every year.
It was questioned again why was the invoice so high from Leo LaLonde? The work is additional work than what was order for the beginning of the year.
The board wanted to know what was order from Midstate (MIS). Superintendent Dow said the town barn was low in inventory for “Adopt A Highway” signs.

Recognition of Guest
Steve Barr – Ace Hardwood – Wanted to let Superintendent Dow know about the damaged storm drain in front of Lois Glass Home. He was told the county had been contacted and were aware of the problem.
On a motion from Councilman Jemison and seconded by Councilman Watters to pay Steve Barr for the work that was done at the Museum as it was missed being put in the abstracts. Ayes – 5

Dan McNamara – Lisbon Assessor – had not comments
Ann Heidenreick - New York State Energy Research and Development Authority – gave a presentation on New York Energy.

Old Business
Health Center Contract – Alan Winney P.A. did not want to sign the contract until he saw what the cost for electricity and heating bill would be for a year. A letter was sent out to him on July 13, 2005 for the total figures for 2004 and total figure as of July 13, 2005.
Councilman Jemison suggested if he hadn’t signed the contract by July 28, then it should be advertise for RFPs in the future.
Councilman Duprey felt we should wait until the first meeting of next month to see if he signs the contract.
The board agreed with Councilman Duprey.
Old Agway Building – When the test results from the previous Agway store was looked over by Attorney Nash he found that there is asbestos in the floor tile. Superintendent LeBarge is going to contract Betty Schaffer on getting the remaining of the test results. The land tax that was paid this year is $240.00. It was questioned if we shouldn’t keep it on the tax roll.
Electrical System at the Town Barn
Councilman Duprey and Superintendent Dow meant with Charlie Benson, Electrical Inspector concerning the wiring at the Town Barn. He recommend that we install a 400 amp box, not a 3 phase wiring. It would be cheaper and we could update anything in the future. He would not give us an estimate on the cost of replace the entry box and wiring throughout the building. Supervisor LeBarge wants to inquire what the cost would be for an entrance box and a price for the wiring. If the prices are too high maybe we should install entry box one year, complete the wiring the next year.
Councilman Duprey and Superintendent Dow will contact Smith Brothers on giving us an estimate price on what the two proposals would cost.

10. New Business

A. Beach – The beach received a $300.00 fine from the Department of Health concerning the chlorinator not working for 3 days and we did not keep records for the two days the chlorinator was down. Attorney Nash was asked for his advice on what to do. He informed the board to pay the fine.
On a motion from Councilman Duprey and seconded by Councilman O’Brian to pay the fine to the Department of Health. Ayes – 5
Nays – 0

B. McBath Rd. - Hollis McBath inquired with Supervisor LeBarge concerning the McBath Road and wanted to know if the road can be grandfathered in on the old highway/road policy instead of the new highway/road policy, which states that the new highway/road needs to have the have black top put on the road. The McBath road was started approximately 10 years ago, before the new policy was brought in. The McBath Road will run from the Tuck Road to the McFadden Road.
On a motion from Councilman Duprey and seconded by Councilman Jemison to have the McBath Road exempt from the new policy as long as the remainder of the road is built to specification. Ayes – 5
Nays – 0

C. The Town Clerk informed the board that she has in possession four checks that were not cashed from last year swimming lessons. They were found in the beach office this year. Since the checks are over a year they cannot be cashed. She has written to each person and asked for a replacement on the checks. She received no answer. Supervisor LeBarge informed her to make a copy of each check and letter and give them to Councilman Duprey.

D. Supervisor LeBarge reported that the town taxable assessment increase over 2004 is $5,634,416.00, which gave the town a change of level of 1.0235 . The property description report will be mailed out July 15, 2005 to every property owner.

12. Executive Session
On a motion from Councilman Duprey and seconded by Councilman Jemison to go into executive session at 8:52 PM concerning union personnel and asked for Superintendent Dow to attend. Ayes – 5

On a motion from Councilman Watters and seconded by Councilman O’Brian to come out of executive session at 9:30 PM Ayes – 5
Nays – 0
