Public Meeting

      1.       Meeting Called to Order

Supervisor Anthony LeBarge called the meeting to order at 6:30 PM For the Local Law

  #1 to Establish Grievance Day as the Fourth (4 th ) Tuesday in May.

Bi-Monthly Meeting

      1.       Meeting Called to Order

      Supervisor Anthony LeBarge called the meeting to order at 6:37 PM

•  Approval of Minutes

On a motion from Councilman Watters and seconded by Councilman Duprey to approve the January 27, 2005 minutes                              Ayes - 5 Nays - 0

•  Approval of Town Clerks Report

On a motion from   Councilman Duprey and seconded by   Councilman Jemison to approve the January 2005 Town Clerks Report.             Ayes - 5 Nays - 0

•  Approval of Supervisors Report

Justice - Account No. 1110.2, amount was placed in wrong acct.   It was moved to 1110.4.

Assessor - Account No. 1355.2, amount was placed in wrong acct.   It was moved to 1355.4

Annual report is not completed as of yet.   There is a problem of balancing the fund balance according to the format that the Comptrollers Office requires and the GASB 34 is not completed.   Supervisor LeBarge is asking for an extension from Comptroller Office on the Annual Report.   When that is finished he will be seeking help from the CPA to set up the correct accounts.

We have received the first sales tax check for the fiscal year of 2005.

Insurance Recoveries 3798.70 - We have received a check from Workman's Comp for Robert Winters reimbursement payment. Supervisor's report accepted by the vote of:

            Discussion

4 sheets of Plywood purchased from Ashley's Home Center - what were they used for?

The sheets are place in back of the cab on the trucks that tip forward to protect the frame and cab.

                        4 mirrors purchased from Beam Mack - what for?

The four split mirrors are placed on the wing towers.   They are replaced at least once a year because of vibrations from the plow.

                        Socket Set from California Contractors Supplies, Inc. - Why from California?

                              They gave the best price.

                        Circuit Breakers from Gillee's Auto Truck & Marine - Where did they go?

                              Installed in the junction box panels in the trucks - 20 & 30 Amps. -

                        Six Coupler plugs and 6 e/x made couplers from Lawson Products, Inc., Ill.

                              Truck Parts for air system in foyer of shop.

Seat Kit for 510 Backhoe LeBerge & Curtis - Why did we purchase a new seat for a Backhoe that we are selling?

The tractor was painted and a new seat was put on so the tractor is worth more than if this was not done.

Six flexible rubber hold downs, Cole-Hersee Toggle Switch and Utility Knife Blades. Why did we buy from Tifco Industries, in Texas and not locally.

      They gave the best price.

Saw from Woodchop Shop Inc.   Did we really need this saw and what is it used for?

The old saw was not usable.   The saw was used to cut blacktop to replace culverts.   To rebuild the old one would cost $480. with no warranty.   The Woodshop gave the best price and it was on State Bid.

Flooring for the Justice Bench - Councilman Duprey thought it would be done in house instead of going out.

Councilman Jemison said Ace Hardwood Flooring was available, while Doug Smith and Scott Skiff were never able to get together at the same time to do the job.   It has been since the middle of December and the bench was not able to be used properly until the floor was installed.

7.       Highway Superintendents Report

St. Lawrence County Highway Superintendent William Dashnaw and Lisbon Highway Superintendent Tim Dow are working together for a road plan for 2005.   The plan at the time is 7.86 miles for Hot Mix.   At the time Black Top is lower in price than last year and crush stone is higher than last year.   The estimate total cost is $329,000.

For the year the Fulton & Murphy roads need to have a culverts replace and the road is ready to be resurfaced.

Supervisor LeBarge had asked for Superintendent Dow to do a wish list based on an additional $100,000 dollars the highway improvement appropriation.

Councilman Watters had asked if there was any more thought about doing a split crew shift.   At this time the guys that are requesting the weekend off, are to sign up on Friday and they would not be called unless there was a severe snow storm.   That arrangement is working at this time according to Superintendent Dow.

      8.       Recognition of Guest

•  Gary Madlin - Had asked what was happening concerning the Bowdish Contract.

Supervisor LeBarge informed him it was all in the attorney hands at the moment.

•  Bill LaRock - Wanted to know if we knew at the time of signing the contract that there were wetlands there and if not would that not have voided the contract?

Attorney Nash informed the board that we had opportunity to view the property prior to signing the contract thus we would have been aware of the conditions which existed.

When the contract was signed the board did not   realize a termination clause, if proper easements for the road construction could not be obtained, had been left out of the contract.

•  Gary Madlin wanted to know what constituted an Executive Session?

Attorney Nash informed him that Executive Session can be on Litigation, Union Contract and negotiations on contracts.

Supervisor LeBarge then informed him that all actions taken are voted on during open session of the meeting.

•    Bill LaRock wanted to comment on how the roads that were resurfaced last year are holding up well.   He also wanted to know if there was any ways of keeping large equipment with chains, trucks or tractor trailer (other than milk trucks) off the roads until the frost is completely out of the ground.

                              Superintendent Dow informed that is was being done, but we can't             police all the roads all the time.   We are trying to do our best.

      9.    New Business

•  New Tractor/Backhoe

Superintendent Dow is recommending we go on state bid for the backhoe.   

On a motion from Councilman Watters and seconded by Councilman O'Brian to approve to purchase the tractor/backhoe on state bid.

Councilman Jemison asked Superintendent Dow why he wanted a John Deere over the other bids we had received.   Superintendent Dow informed the board that by purchasing the John Deere we already have certain attachments that would fit the new John Deere.   If we purchase any other backhoe we would have to buy the attachments to go with it.

On a motion from Councilman Jemison and seconded by Councilman Watters to advertise the backhoe out for open bid.   Also send pictures direct to the John Deere's headquarters to see what we can be offered there.   The advertisement is to be placed in the Ogdensburg Journal and Watertown Daily Times.   The bids are to be returned by March 8, 2005 at 4:30 PM for the meeting on March 9, 2005. Ayes - 5 Nays - 0

On a motion from Councilman Duprey and seconded by Councilman O'Brian on a Resolution #1 for purchasing a John Deere 320G as specified in the state bid description.

Resolution # 1 as stands:

            Resolution # 1 -   The Lisbon Town Board authorizing the purchase of a 310G

Backhoe/Loader with extendable dipper stick from New York State Contract award number 18896.   Item number 12 and 12B for $45,693.00

Also, the Town Board will determine if a trade-in allowance is acceptable or an outright purchase.                     Ayes - 5 Nays - 0

On a motion from Councilman Jemison and seconded by Councilman Duprey to accept the bid from F.K. Gailey #7367, LaFargeville, NY on LSD 25 for $1.4525/gallon as it was the lowest quote.                                             Ayes - 5 Nays - 0

            There were no comments on the Public Meeting.

On a motion from Councilman Duprey and seconded by Councilman O'Brian to accept the Local Law # 1.                             Ayes - 5 Nays - 0

Councilman Jemison will be asking Maintenance Man Scott Skiff to get prices on a good shampoo machine to clean the carpet for the Town Hall and the Library.

Bill LaRock had inform the board that Lowell Nelson has a field off the Hardscrabble Road that he is willing to sell to the town as a source for sand.

      12.       Executive Session

      On a motion from Councilman Duprey and seconded by Councilman O'Brian to go into

executive session at 7:50 PM to discuss Pending Litigation in State representing to whom it may concern and Union Contract.          Ayes - 5 Nays - 0

On a motion from Councilman O'Brian and seconded by Councilman Jemison to return to regular meeting at 9:00 PM.               Ayes - 5 Nays - 0
