1. Meeting Called to Order
Supervisor LeBarge called the meeting to order at 6:30 PM.

2. Approval of Minutes
On a motion from Councilman Watters and seconded by Councilman Duprey to
approve the minutes of the September 8, 2004 with the corrections in New Business to correct the grammar: “Supervisor LeBarge informed the board that he would contact Mr. McDonell to get iron out better specification on the amount of fill required to construct the basketball court and bring the information to the board at the next meeting.” Change to: “Supervisor LeBarge informed the board that he would contact Mr. McDonell to clarify the specification on the amount of fill required to construct the basketball court and bring the information to the board at the next meeting.” Ayes – 5

Recognition of Guest
Steve Barr – Ace Hardwood Flooring – Reported that the Town Barn the paint job is completed as is the roof of the annex of the Town Hall. The windows will be installed on Friday, September 23, 2004 and he will be repairing two windows in the Town Hall also. He also noted that we would be receiving a warranty on the windows that are being installed in the Town Clerk’s office.

Old Business
Sand Pit – Councilman Jemison wanted it to be noted that if we receive the permit to install a road in the Sand Pit, he has informed the board that he would like for us to wait to see if we need sand prior to road’s installation. Supervisor LeBarge informed the board from the meeting of September 8 he was just asking for the board to approve for him apply for the permit only.
Mill Road Bridge – Highway Superintendent Dow has informed the board that the diversion pipe has been installed and the steel piping for the bridge has been delivered and will be installed soon. He informed the board he had received 3 verbal quotes for the piping. Supervisor LeBarge asked Superintendent Dow again if he had the written quotes from the companies. All the Town Clerk has received are hand written quotes that Superintendent Dow had received verbally over the telephone.
Adirondack $4362.00 plus freight
Oswego Tool & Steel $4950.00 plus freight
Lane Ent. $5140.81 with freight
Superintendent Dow purchased from Adirondack.
Brown Road resurfacing – Cost for materials for 1.59 miles will be $46,988 and to do the remaining .7 miles will cost $29,384. The county informed Superintendent Dow that they could be on the job by October 1.
Nelson Road – Cost for materials for 2.1 miles will be $86,152
Flack Road – Cost for materials for .8 mile will be $34,078
Cemetery Road – Cost for materials for .7 mile will be 32,122

$3000 will be _ stone and _ labor for shoulder work per mile.

G. We have received $9,000 from Town of Oswegatchie for the use of the Zipper.
We should be receiving the money from the County for the use of the Zipper soon.
On a motion from Councilman Jemison and seconded by Councilman Watters to approved the sub-appropriation account 51.12 of $100,000 to proceed with the Brown Road as long as cash flow allows it and weather permits.

New Business
A. Rabies Clinic – Town Clerk had inquired with the SLC Board of Health on a yearly rabies clinic to be done in the Town of Lisbon. She was informed from the Board of Health that all small towns will have a rabies clinic every three years starting 2005. She had asked for the board’s approval to write to the SLC Board of Health and ask for a yearly clinic in Lisbon.
On a motion from Councilman Watters and seconded by Councilman Jemison to have the Town Clerk write a request to the SLC Board of Health and request to have a yearly rabies clinic instead of a every 3 year clinic. Ayes – 5
Nays - 0

RESOLUTION SUPPORTING RESTORATION OF TRAFFIC FINE REVENUE

WHEREAS, Vehicle and Traffic Law, 1803 governs the disposition of fines and penalties collected in connection with convictions pursuant to the Vehicle and Traffic Law; and

WHEREAS, Chapter 56 of the Laws of 2004, effective August 20, 2004, changed the distribution of the fines taking them away from municipalities and placing them in the State Treasury, and

WHEREAS, the change in the fine and penalties distribution formula will result in a lost to local taxpayers of more than $20 million in fine monies – monies which have historically been used to fund justice court operations; and

WHEREAS, the Town of Lisbon will likely lose $20,000 in anticipated fine revenues; and

WHEREAS, the State Budget provision with its immediate effective date will result in significant 2004 deficits and will negatively impact town property tax rates for 2005; NOW THEREFORE BE IT

RESOLVED, that the Town of Lisbon calls for the restoration of the original fine distribution formula in order to provide town with necessary revenues to fund justice court operations; AND BE IT FURTHER

RESOLVED, that the Town of Lisbon urges the passage of legislation introduced by Senator Bonacic (S,7757) and Assemblyman Cahill which amends the Vehicle and Traffic Law to restore this source of revenue to local governments, AND BE IT FURTHER

RESOLVED, that a copy of this resolution be sent to the Governor George E. Pataki; Joseph L. Bruno, majority Leader of the Senate; Sheldon Silver, Speaker of the Assembly; Senator Elizabeth Little, Chair of the Local Government Committee; Assemblyman Robert Sweeney, Chair of the Local Government Committee; Senator Owen Johnson, Chair of the Finance Committee; Assemblyman Herman D. Farrell Jr., Chair of the Ways and Means Committee; Senator John A. Defrancisco, Chair of Judiciary Committee; Assemblywoman Helene E. Weinstein, Chair Judiciary Committee; and Senator James Wright; Assemblyman Darrell Aubertine.

On a motion from Supervisor LeBarge and second from Councilman Jemison to have Town Clerk McBath mail the Resolution Supporting Restoration of Traffic Fine Revenue to each that is listed in Resolution. Ayes – 5
Nays – 0

Change Meeting October 13, 2004 – Supervisor LeBarge had informed the board
that he would be unable to attend the meeting on October 13, 2004 and wanted to
know if the board wanted to postpone the meeting to another night or remain as is
and have Deputy Supervisor Watters conduct the meeting. The board has
requested to have the meeting on October 13, 2004 and have Deputy Supervisor
Watters conduct the meeting.
Union Meeting September 28, 2004 as schedule
Budget Meeting – Supervisor LeBarge would like to schedule a budget meeting before the September 30, 2004 dead line that it needs to be filed with the Town Clerk or meet after tonight meeting. The board is meeting tonight.
