1. Meeting Called to Order
Deputy Supervisor Watters called the meeting to order at 6:30 PM.

2. Minutes
On a motion from Councilman Jemison and seconded by Councilman Duprey to approve the minutes of the January 22, 2004
Ayes - 4

3. Recognition of Guest
Wendall Brander
Mr. Brander has requested to have the Heuvelton Road put on the schedule for repairs or replacing in the year 2004.

4. Donald Hassig - Director Cancer Action NY
He has requested that the Town Board call upon the New York State Legislature to ban open waste burning statewide.
5. Allen Nichols - Oswegatchie Town Supervisor
Supervisor Nichols is requesting that the Town of Lisbon join with the Township of Oswegatchie and the Village of Heuvelton in exploring the establishment of a joint water/sewer district along State Highway 37 near Ogdensburg.

A motion from Councilman Jemison and seconded by Councilman O'Brian to support authorizing and Supervisor and Representative to meet Oswegatchie/Heuvelton Officials to explore the water/sewer district.

6. Town Clerks Report
On motion from Councilman Jemison and seconded by Councilman Watters to approve the Town Clerks report. Ayes - 4

7. Supervisor Report
Deputy Supervisor Watters informed the board that Bookkeeper, Beverly Patchin was not able up date Supervisor's Report with budget figures due to time constraints.

On a motion from Councilman Jemison and seconded by Councilman O'Brian to accept the Supervisor's Report. Ayes - 4

8. Highway Superintendent's Report
Superintendent Dow informed the board that he now has 3 pickup with high mileage. He is requesting to go to bid for a new truck. If he goes with a state bid, it may take approximately 9 month to receive the vehicle. Therefore, he is asking to go outside of state bid and to go to open bidding. He feels that we could get just as good or better price.

The board authorized Superintendent Dow to draw up specs for truck desired and have available for the February 26 meeting.

9. Report on Audit Committee and Approval of Abstracts
On a motion from Councilman Duprey and seconded by Councilman O'Brian to accept Abstracts. Ayes - 4

11. Old Business
A. Wood Harvesting
Don Brown has been contracted and indicated two weeks before he would start
marking trees at Diamond Lot.
B. Procurement Policy
On a motion from Councilman Jemison and seconded by Councilman Duprey to accept the Procurement Policy with a corrections in Item 5 last sentence to read as; "The only exception will be if an emergency exists and the procurement officer is unavailable and such an instance will require a report of the purchases to the supervisor and/or Board within 48 hours of the purchases."

Councilman Jemison suggested getting a second opinion and prices. He is
contacting Computer Heaven of Canton to set up an appointment.
E. NYSERDA
Energy audit was taken.
F. Town Supervisor Job Description
On a motion from Councilman Duprey and seconded by Councilman Jemison to accept the Town Supervisor Job Description

12. New Business
A. Approval of Dog Census
Attorney Nash would look into whether or not the Town Clerk has the authority to charge $5.00 per/dog for any unlicensed dog found during census.
For each dog that the Animal Control Person locates, he receives $1.00.
B. Hooper & Van House - Town Clerk Audit Report -Was reviewed
C. Lisbon Marching Band Boosters - Town Hall
A motion from Councilman Jemison and seconded by Councilman Duprey that the Town Hall can be used by the Lisbon Marching Band Boosters for a dance to be held on March 19, 2004. They will be a $50.00 deposit and the deposit will be returned to them after the Town Hall has been inspected

D. Pickup Truck for Campground and Cemeteries Mowers - Supervisor LeBarge is
Requesting permission to buy a truck for the campground for no more than $10,000 The funds for the pickup will come from the contingency fund.

A motion from Councilman Jemison and seconded by Councilman O'Brian to have Supervisor LeBarge to get two estimates for campground truck in compliance with Procurement Policy. Ayes - 4

E. Sales Tax - Copy of Potsdam - Attorney Nash has informed the board that this issue is a dead issue at county level and therefore any further action by the Town Board would be moot.
F. Support of Collateral Source Bill -
A motion from Councilman Jemison and seconded by Councilman Duprey to support the Collateral Source Bill sponsored by Assemblyman Harvey Weisenberg, that would amend Section 4545 of the Civil Practice Law and Rules.

G. Senior Tax Exemption - Attorney Nash has suggested that the board postpone this issue until for the upcoming summer, because the passage of a local law is necessary to implement a change in this policy.
Town Assessor Kim Bisonette has suggested that we go on a sliding scale when I this issue is revisited.
H. Laws Digest & Office of Town Clerk and Tax Collection - Town Clerk McBath was ask to order Office of Town Clerk and Tax Collection manuals and Highway Superintend Manaul.

13. Committee Reports
A. Planning Board - Report on file for February and there was no other discussion.
B. Recreation Committee - Reports on file for January 17and February 10, 2004
C. Campground - No Report
D. Museum - No report was given - The Museum committee is looking for Senior
Citizens to come and talk with the community and talk about the past experience in their life
E. Homecoming - The committee has turned in the minutes from January 17 and
February 10, 2004. There was no other discussion.
F. Economic Development - The board was informed that there will be a meeting on
February 18 if anyone wants to attend. 3:30 PM at the Oswegatchie Town Hall.
G. Library - No meeting this month.
H. Youth Program - No Report
I. AMP - Regular Meeting on February 12

14. Executive Session
A. A motion from Councilman Jemison and Seconded by Councilman Duprey to go
into executive session at 8:47 PM concerning Individual. Ayes - 4

B. On a motion from Councilman Jemison and second by Councilman O'Brian to
return to regular session at 9:25 PM.
Ayes - 4

15. Position for Highway Superintendent
The Board had decided to wait until there is a full board to make the appointment for
Highway Superintendent. Superintendent Dow is to continue to work as usual and he was informed that the appointee would have to run for the office in the general election 2004

On a motion from Councilman Jemison and seconded by Councilman Duprey to adjournment the meeting at 9:30 PM.
